HomeMy WebLinkAboutOrd.365.08-18-1986 �^• BILL NO. 86-102 ORDINANCE N0. <���5 AN ORDINANCE AMENDING CHAPTER 30 OF THE CITY CODE DEFINING AND REGULATING BILLBOARDS BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU, MISSOURI , AS FOLLOWS: SECTION 1 . The purpose of this ordinance is to reduce hazards to pedestrians and motorists caused by billboards and to preserve and improve the appearance of the City thereby improving the quality of life and furthering the goals of community growth and economic development . SECTION 2 . Chapter 30 of the Code of Ordinances of the City of Cape Girardeau, Missouri , is hereby amended by adding the following definitions to Section 30-3 : Sec. 30-3 . Definitions . Billboard: Any sign or structure used or designed for the outdoor display of commercial or noncommercial messages the sign face of which exceeds one hundred � ( 100 ) square feet in area . Billboard, Back-to-Back : A structure with two ( 2 ) parallel sign faces oriented in opposite directions. Billboard, V-Type: A structure or structures with two ( 2 ) sign faces, forming the shape of the letter "V" when viewed from above, with an angle between the two ( 2 ) faces of not more than sixty ( 60 ) degrees . Sign Face: That portion of a billboard, including the display area, border and trim, but excluding the base, supports, and other structural members . SECTION 3 . Chapter 30 of the Code of Ordinances of the City of Cape Girardeau , Missouri , is hereby amended by repealing Section 30-29 (a ) ( 4 ) and enacting a new Section 30-29 ( a ) ( 4 ) to read as follows: Sec. 30-29 (a ) ( 4 ) Billboard or poster panel , provided such billboard or poster panel is not erected within one hundred ( 100 ) feet of the side and rear yard of a lot in an "R" District . � All other subsections of Section 30-29 shall remain in full � force and effect. SECTION 4 . Chapter 30 of the Code of Ordinances is further amended by adding the following section: Sec . 30-40 . Billboards . ( a) Billboards � shall be allowed only on parcels of land bordering the following streets: I-55 Route K William Street Independence Street Broadway Highway 74 Kingstiigtiway from Bouldercrest Drive to the South city limits . (b) No billboard shall be placed within five hundred ( 500 ) feet of another billboard. This subsection shall not apply to billboards which are located on opposite sides of the street to which the billboard is oriented. ^ ( c ) No billboard shall be placed within thirty ( 30 ) feet of a street . ( d) No billboard shall be placed within one hundred ( 100 ) feet of a residential structure. ( e ) For purposes of placing billboards, a V-type billboard or a back-to-back type billboard shall be considered one ( 1 ) billboard. ( f ) No billboard shall be located in such a manner as to obscure an official traffic sign, signal or device, or obstruct a driver ' s view of approaching or intersecting traffic. (g) The maximum area of a billboard sign face shall be three hundred ( 300 ) square feet . The maximum lenqth of a billboard sign face shall be thirty ( 30 ) feet . (h ) There shall be a minimum clearance of ten ( 10 ) feet from grade of the street to which the billboard is oriented to the bottom of a billboard sign face. There shall be a maximum height of thirty ( 30 ) feet from grade of the street to which the billboard is oriented to the � top of a billboard sign face . ( i ) Billboards may be illuminated, subject to the /`* following restrictions : 1 . No revolving or rotating beam or beacon of light shall be permitted as part of any billboard. Flashing devices shall not be permitted upon a billboard. However , illuminated billboards which indicate customary public information, such as time, date, temperature or other similar information shall be permitted. 2 . External lighting, such as flood lights , thin line and goose neck reflectors , are permitted, provided the light source is directed on the face of the billboard and is effectively shielded so as to prevent beams or rays of light from being directed into any portion of the street . 3 . The illumination of any billboard within one hundred ( 100 ) feet of a residential zone shall be diffused or indirect in design to prevent direct rays of light from shining into adjoining residential districts . ^ ( j ) The following billboards shall not be permitted to remain or to be erected: 1 . Billboards which have been erected without a building permit . 2 . Billboards which are not clean and in good repair . 3 . Billboards which appear to attempt to regulate, warn, or direct the movement of traffic or which interfere with, imitate, or resemble any official traffic sign, signal or device . 4 . Billboards which are erected or maintained upon trees or painted or drawn upon rocks or other natural features . 5 . Billboards which are nonconforming and damaged or destroyed to an extent of more than sixty ( 60 ) per cent of fair market value . 6 . Billboards that prevent ingress or egress from any doors, windows, or fire escapes . /� Billboards that are attached to a standpipe or fire escape . SECTION 5 . If any section , subsection, sentence, clause, � phrase or portion of this ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portions hereof . SECTION 6 . It is the intention of the governing body and it is herby ordained that the provisions of this ordinance shall become and be made a part of the Code of Ordinances of the City of Cape Girardeau , Missouri , and the sections of this Code may be renumbered to accomplish such intention .
