AN ORDINANCE AMENDING CHAPTER 7 OF THE CITY
CODE BY EXTENDING THE TWO MONTH MORATORIUM
ON THE ISSUANCE OF BUILDING PERMITS FOR
BILLBOARDS FOR AN ADDITIONAL EIGHT WEEKS
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE
GIRARDEAU, MISSOURI , AS FOLLOWS:
SECTION 1 . Section 7-3 of the Code of Ordinances of the
City of Cape Girardeau, Missouri , is hereby amended by
repealing subsection 13 and adding a new subsection 13 to read
as follows:
" ( 13 ) Article 19 is amended by adding a new
Section 1916 to read as follows:
SECTION 1916 BILLBOARDS
1916 . 1 All other provisions of this Code to
the contrary notwithstanding, it shall be
unlawful to construct, enlarge or alter any
�-., billboard without first obtaining a building
permit .
1916 . 2 No building permit shall be issued
to construct, enlarge or alter any billboard
from May 8 , 1986 until September 1 , 1986 . "
SECTION 2 . If any section, subsection, sentence, clause,
phrase or portion of this ordinance is for any reason held
invalid or unconstitutional by any court of competent
jurisdiction, such portion shall be deemed a separate, distinct
and independent provision and such holding shall not affect the
validity of the remaining portions hereof .
SECTION 3 . The City Council intends to consider an
ordinance to proscribe or further restrict the construction of
billboards . The Council determines that such action is
necessary to preserve the public peace, property, health,
safety and morals . The Council further determines that while
the imposition of billboard restrictions are under
consideration it is highly probable that numerous applications
for billboard building permits will be filed. Accordingly, it
is hereby declared an emergency exists as provided for in
Section 3 . 15 of the City Charter for the City of Cape
Girardeau , Missouri in that the immediate preservation of the
.� public peace , property, health, safety and morals requires that
a temporary moratorium be placed on the issuance of building
permits for billboards .

SECTION 4 . This ordinance shall be in full force and
effect from and after its passage and approval .
