AN ORDINANCE CALLING A SPECIAL ELECTION IN
THE CITY OF CAPE GIRARDEAU, MISSOURI , ON THE
QUESTION WHETHER TO APPROVE THE PROPOSED
SOLID WASTE COLLECTION AND LANDFILL FEES;
DESIGNATING THE TIME OF HOLDING THE
ELECTION; AUTHORIZING AND DIRECTING THE CITY
CLERK TO GIVE NOTICE OF THE ELECTION; AND
DECLARING AN EMERGENCY TO EXIST
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE
GIRARDEAU, MISSOURI , AS FOLLOWS:
SECTION l . A special election is hereby ordered to be held
in the City of Cape Girardeau, Missouri , on Tuesday, August 5,
1986 , on the following question:
QUESTION
Shall the proposed solid waste collection and landfill
fees be approved? The proposed fees are as follows:
^ (a) The monthly solid waste collection fee for
residential customers shall be $4 . 85 per dwelling
unit,
(b) The monthly collection fee for commercial
customers using storage containers shall be as
follows :

(c) The fee for commercial customers for hand pickup
shall be $. 50 per collection minute but not less
than $5 . 00 per month.
(d) Commercial customers with privately owned
compactors 8 cubic yards or less will be charged
a fee of $2 .00 times the rated yardage of the
container per pickup. Commercial customers with
privately owned compactors larger than 8 cubic
yards will be charged a fee of $3 . 25 times the
rated yardage of the container per pickup.
^ (e) Commercial customers with over.loaded containers
shall pay a collection fee at the hand pickup
rate for such overload .
( f ) The fee for special commercial pickups shall be
at the hand pickup rate.
(g) Charges for use of the City landfill shall be at
the rate of $3 . 00 per cubic yard or fraction
thereof .
SECTION 2 . The form of the notice of election for the
special election, a copy of which is attached hereto and made a
part hereof , is hereby approved.
SECTION 3 . The City Clerk is hereby authorized and
directed to notify the County Clerk of Cape Girardeau County,
Missouri of the passage of this ordinance no later than 5 : 00
o' clock P. M, on June 10 , 1986 , and to include in the
notification all of the terms and provisions required by the
Comprehensive Election Act, Chapter 115, Missouri Revised
Statutes , 1978 , as amended .
SECTION 4 . It is hereby found and declared that an
emergency exists as provided for in Section 3 . 15 of the City
Charter for the City of Cape Girardeau , Missouri , in that the
,,� election authority, under the time of notice provision set
forth in Section 115 . 125 , Missouri Revised Statutes , 1978 , as
amended, must be notified not later than 5 : 00 o' clock P.M. on
� June 10 , 1986 of an election to be held on August 5 , 1986 . It
is hereby further found and declared that calling an election
and providing for the submission of a proposal to the people is
an emergency measure as provided for in Section 3 . 15 (d) of the
City Charter of the City of Cape Girardeau, Missouri .
SECTION 5 . This ordinance shall be in full force and
effect from and after its final passage.

CITY OF CAPE GIRARDEAU, MISSOURI
Notice is hereby given to the qualified voters of the City
of Cape Girardeau, Missouri , that the City Council of the City
has called a special election to be held in the City on August
5 , 1986 commencing at 6 : 00 o' clock A.M. and closing at 7 :00
o' clock P.M. on the question contained in the following sample
ballot:
