AN ORDINANCE AMENDING CHAPTER 16A OF THE
CITY CODE TO PROHIBIT LITTERING ON PRIVATE
PROPERTY AND TO REQUIRE PRIVATE PROPERTY TO
BE MAINTAINED FREE OF LITTER
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE
GIRARDEAU, MISSOURI , AS FOLLOWS:
SECTION 1 . Section 16A-18 of the Code of Ordinances of the
City of Cape Girardeau, Missouri , is hereby repealed in its
entirety.
SECTION 2 . Chapter 16A of the Code of Ordinances of the
City of Cape Girardeau, Missouri , is hereby amended by adding
the following:
Sec. 16A-18 . Litter on Occupied Private
Property
No person shall throw or deposit litter
on any private property within the City,
,� whether owned by such person or not;
provided, however , that this section shall
not prohibit the deposit or storage of
litter in receptacles for collection.
SECTION 3 . Chapter 16A of the Code of Ordinances of the
City of Cape Girardeau, Missouri , is hereby amended by adding
the following:
Sec. 16A-21 . Owner to Maintain Premises Free
of Litter .
The owner or person in control of any
private property shall at all times maintain
the premises free of litter . Provided,
however , that this section shall not
prohibit the storage of litter in
receptacles for collection.
SECTION 4 . The repeal of Section 16A-18 provided for in
Section 1 hereof shall not affect any offense or act committed
or done or any penalty or forfeiture incurred before the
effective date of this ordinance.
