AN ORDIi1ANCE VACATI[VG THE WESTERN FIVE FEET
OF THE FOREST AVET�UE RIGHT-OF-�aAY BETY7EEN
DUNKLIN STREET AND NEW MADRID STREET
��HEREAS, the City Council has received a request from Mrs .
Janice E , Thiele that the City vacate a portion of the Forest
Avenue right-of_-way between Dunklin Street and New Madrid
Street ; and
WHEREAS , the City Council set the date of April 2 , 1986 for
a public hearing on this request ; and
6JHEREAS , at least ten days notice of the time and place of
this hearing was published in a newspaper of general
circulation in the City; and
4�HEREAS , a public hearing was held on April 2 , 1986 at
which all interested parties were afforded the opportunity to
speak in favor of or in opposition to the proposed vacation of
street right-of-way; and
'^� WHEREAS, the City Council has determined that the
right-of-way in question is not necessary or needed for any of
the purposes for which it was dedicated and established; and
WHEREAS, it is in the public interest that the right-of-way
easement be vacated ;
NOG�, THEREFORE , BE IT ORDAINED BY THE COUNCIL OF THE CITY
OF CAPE GIRARDEAU, MISSOURI , AS FOLLOWS:
SECTION 1 . The City ' s right-of-way easement on the
following described real estate:
The Western five feet of the Forest Avenue
right-of-way between Dunklin Street and New
Madrid Street as shown on Foster-Cobbel ' s
First Subdivision, a subdivision of part of
Lot 17 , 18 , 21 and 22 of Walker ' s
Subdivision of Out Lot 60 , and U . S . P . Survey
No . 2199 , in the City and County of Cape
Girardeau, Missouri .
is hereby vacated .

SECTION 2. This Ordinance shall be in full force and
