The City P9anager on behalf of the City of Cape Girardeau, Missouri , is hereby authorized to enter into an Electronic Data Processing Agreement with the Municipal Library District of the City of Cape Girardeau. A copy of this ' Agreement is attached to this Ordinance and made a part hereof . SECTIOr1 2 . This ordinance shall be in full force and effect ten days after its passage and approval . Stoverink , City C erk � i bD:ux 445 2,1S` 51 ELECTRONIC DATA PROCESSING AGREEMENT This Agreement made this day of �j J�', , 1986 , by and between the City of Cape Girardu, Missouri , hereinafter called "City" and the Municipal Library District of the City of Cape Girardeau, hereinafter called "Library. " In consideration of the mutual covenants, terms and conditions hereinafter set forth the City and Library agree as follows : 1 . City shall provide Library access to its Prime 9750 central electronic data processing unit . Communications shall be over a 16 channel 4800 Baud rate multiplexor over dedicated data phone line. City agrees to maintain and operate the system on a 24-hours per day, 7-days per week basis. Library shall have continuous access to the unit without interruption except for predetermined system back-up and maintenance schedules and equipment failures beyond the control of City. 2 . City agrees to dedicate to Library' s use the core memory access and disk storage required by Library's software vendor in order to guarantee software system performance. City shall provide Library with up to 600 MB disk storage. City agrees to expand the core memory of the unit if such expansion becomes necessary to meet the needs of Library. 3 . Library shall pay City the sum of $73 ,550 .00 within thirty ( 30 ) days of the execution of this Contract . 4 . City shall advance funds to Library within thirty days of a written request from Library up to a cumulative maximum of $75 ,000 . 00 to pay for the following items : A. Software capable of handling MARC tapes for the functions of circulation, cataloging and on-line catalog. B. Machine readable bibliographical data (MARC tapes) . C . Site preparation for terminals. D. ID cards. E . Machine readable labels for 14,000 ID cards . F. Machine readable labels for 113 ,000 items. G. Estimated software maintenance. 5. All unrestricted gifts received by Library after funds have been advanced to Library by City shall be promptly paid to City in repayment of such advances. Library shall repay City the remaining principal amount of funds advanced pursuant to this Agreement over a three ( 3 ) year period beginning the first i-.). ,x445 : GE 54 year after the Library receives funds from a voted library tax increase. Library, at its option, may repay City from any other funds legally available . 6 . Library shall pay City an annual data processing fee of $2 ,000 .00. This fee shall be subject to negotiation after five (5 ) years . 7 . This Agreement shall be in effect for a period of ten ( 10 ) years from and after its execution. Library's obligation to repay funds advanced by City, however , may extend beyond the term of this Contract. 8 . This Agreement may be amended from to time by mutual agreement of the City and Library. IN WITNESS WHEREOF, the parties have caused this Agreement to be executed the day and year first above written.
