AN ORDINANCE VACATING THE CITY ' S INTEREST IPd
A SEWER AND UTILITY EASEMENT AT 2613-2615
THEMIS STREET IN THE CITY OF CAPE GIRARDEAU ,
MISaOURI
WHEREAS, the City Council has received a request from First
Exchange Corporation on behalf of Hansel L . and Paula J.
Andrews that the City vacate a sewer and utility easement on
property owned by the Andrews at 2613-2615 Themis Street and
more particularly described in Section 1 hereof ; and
WHEREAS , the City Council set the date of March 5 , 1986 for
a public hearing on this request ; and
WHEREAS, at least ten ( 10 ) days notice of the time and
place of this hearing was published in a ne��spaper of general
circulation in the City; and
WHEREAS, a public hearing 4�as held on March 5 , 1986 at
which all interested parties were afforded the opportunity to
speak in favor of or in opposition to the proposed sewer and

utility easement vacation; and
WHEREAS, the City Council has determined that the easement
in question is not necessary or needed for any of tlle purposes
for which it was dedicated and established; and
ti�HEREAS, it is in the public interest that the easement be
vacated;
N04d, THEREFORE , BE IT ORDAINED BY THE COUPICIL OF THE CITY
OF CAPE GIRARDEAU, MISSOURI , AS FOLLOWS:
SECTION 1 . The City ' s interest in the sewer and utility
easement on the following described real estate:
A strip of land five feet on either side of the lot
line between Lots 3 and 4 of Block 7 of Crite ' s Third
Addition to the City and County of Cape Girardeau ,
Missouri .
is hereby vacated.
SECTION 2 . This ordinance shall be in full force and
effect ten days after its passage and approval .
