HomeMy WebLinkAboutOrd.297.02-19-1986 '� BILL N0. 86-12 ORDINANCE N0. � AN ORDINANCE AUTHORIZING THE CITY MANAGER TO ISSUE TEMPORARY CATERERS ' PERMITS TO SELL INTOXICATING LIQUOR BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU, MISSOURI , AS FOLLOWS: SECTION 1 . Section 5-14 of the Code of Ordinances of the City of Cape Girardeau, Missouri , is hereby repealed in its entirety. SECTION 2 . A new Section 5-14 of the Code of Ordinances of the City of Cape Girardeau, Missouri , is hereby enacted to read as follows : "Sec. 5-14 . Temporary caterers ' permit . , (a) Upon payment of the license fee herein provided, the city manager may issue a temporary permit to caterers and other persons holding licenses to sell intoxicating liquor by the drink at retail for � consumption on the premises pursuant to the provisions of this chapter who furnish provisions and service for use at a particular function, occasion or event at a particular location other than the licensed premises , but not including a "festival" as defined in Chapter 316 RSMo, effective for a period not to exceed one hundred twenty ( 120 ) consecutive hours, which shall authorize the service of alcoholic beverages at such - function, occasion or event during the hours at which alcoholic beverages may lawfully be sold or served upon premises licensed to sell alcoholic beverages for on-premises consumption , (b ) All ordinances , rules and regulations shall extend to such premises and shall be in force and enforceable during all the time that the permittee, its agents, servants , employees or stock ar_e in such premises . This section shall not include, nor authorize the sale of packaged goods . " SECTION 3 . If any section , subsection , sentence, clause, phrase or portion of this ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portions hereof . � /'~� SECTION 4 .
