AUBURN CHRISTIAN CHURCH, FOR PURPOSES OF LOCATING A MODULAR BUILDING FOR TEMPORARY SUr]DAY SCHOOL CLASSROOMS AT 930 MT. AUBURN ROAD, IN THE CITY AND COUNTY OF CAPE GIRARDEAU , MISSOURI WHEREAS, Mt . Auburn Christian Church is the owner of certain property in the City of Cape Girardeau, on which it desires to locate a modular building for temporary sunday school classrooms ; and WHEREAS , the proposed location of said modular building is 930 Mt. Auburn Road, which property is presently zoned R-1 , Single-Family Dwelling District; and WHEREAS, a Special Use Permit is required for said use; NOW, THEREFORE , BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU, MISSOURI , AS FOLLOWS: �' SECTION 1 . The City Council having duly considered the application finds that the granting of the Special Use Permit will not substantially increase traffic hazards , congestion, fire hazards or adversely affect the general character of the neighborhood or the general welfare of the community, nor will it overtax public utilities or be in conflict with the comprehensive plan . SECTION 2 . A Special Use Permit for purposes of locating a modular building for temporary sunday school classrooms , on the following described property: A parcel of land containing 3 . 33 acres , more or less , located in Out Lot 78B, U .S. Survey No. 2199 , Township 31 North , Range 13 East , described as follows : Start at the Northwest corner of said Out Lot 78B, thence South 6° 0 ' West, along the West line of said Out Lot 245 , 0 f_eet; thence South 84° 0 ' East , 35 . 0 feet to a point in the Fast line of Mount Auburn Road for the point of beginning; thence South 87° 50 ' East, 135 . 8 feet to a point in the West line of a 1 . 423 acre parcel ; thence South 4° 10 ' West , 60 . 8 feet to the Southwest corner of said parcel ; thence South 85° 30 ' East, 280 . 0 feet to the Southeast corner thereof; thence South 8° 54 ' East 261 . 2 feet; thence South �-.,�, 81° 22 ' West, 501 . 3 feet to a point in the East line of P9ount Auburn Road; thence North 6° 0 ' East, along said East line, 443 . 5 feet to the point of beginning. is hereby granted to Mt . Auburn Christian Church, to be effective ten ( 10 ) days after the date of passage and approval � of this ordinance. The special use must comply with all regulations set forth in the Zoning Code for the district in which the use is located except those which have been specifically excepted under this permit, and all other applicable ordinances of the City of Cape Girardeau and any special conditions contained in the Special Use Permit, a copy of which is attached hereto and incorporated herein by reference. The City Manager is hereby given the power to execute the Special Use Permit for and on behalf of the City of Cape Girardeau , Missouri . SECTIOr] 3 . This Special Use Permit is granted upon the condition that the Applicant be bound by all City Ordinances which pertain to � the special Use Permit and that the Applicant be bound by the following conditions which are imposed as a condition of issuance of this Special Use Permit . Upon the failure of the Applicant to comply with these special conditions , the Special Use Permit will automatically terminate with the right of the City of Cape Girardeau to enter upon the land to abate such special use. SPECIAL CONDITIONS: 1 . The modular building shall be located as indicated on the drawings submitted with the application for Special Use Permit . 2 . This special use p�rmit shall expire two ( 2 ) years from the date it is issued .
