AN ORDINANCE GRANTING A SPECIAL USE PERMIT
TO KEITH H . LEE AND GAIL LEE, FOR PURPOSES
OF CONSTRUCTING AND MAINTAINING A BUSIPIESS
SIGN AND FOR ENLARGEMENT OF THE PARKING AREA
AT 2601 HOPPER ROAD, IN THE CITY AND COUNTY
OF CAPE GIRARDEAU, MISSOURI
WHEREAS , Keith H . Lee and Gail Lee are the owners of certain
property in the City of Cape Girardeau, in which they desire to
construct and maintain a business sign and to enlarge the parking
area; and
WHEREAS , the proposed location of said sign and parking lot is
2601 Hopper Road, wlzich property is presently zoned C-2, General
Commercial District ; and
4�HEREAS , a Special Use Permit is required for said use in a
C-2 zone;
N04d, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
CAPE GIRARDEAU, MISSOURI, AS FOLLOWS:
SECTION 1 . The City Council having duly considered the
application finds that the granting of the Special Use Permit will
not substantially increase traffic hazards , congestion, fire
hazards or adversely affect the general character of the
neighborhood or_ the general welfare of the community, nor will it
overtax public utilities or be in conflict with the comprehensive
plan .
SECTION 2 . A Special Use Permit for purposes of constructing
and maintaining a business sign and for enlargement of the parking
area , on the following described property:
A Part of Lot 6 of Pleasant Acres Subdivision in the
City and County of Cape Girardeau , Missouri (As shown
on Plat Book 5 , Page 11 ) , described as follows:
Commence at the Northwest corner of said Lot 6 ; thence
S . 86° 00 ' E. , with ttle North line of said Lot 6 , 80 . 0
feet for the point of beginning; thence S. 4° UO ' ��. ,
109 . 0 feet to the South line of said Lot 6 ; thence N.
77° 58 ' E. , with said South line , 133 . 6 feet to the
East corner of said Lot 6 ; thence N. 35° 20' W, with
the northeast line of said Lot 6 , 99 . 3 feet to the
North Line of said Lot 6 ; thence N . 86° 00' W. along
saic9 North line , 60 . 0 feet to the point of beginning.
is hereby granted to Keith H . Lee and Gail Lee , to be effective
ten (10 ) days after the date of passage and approval of this
ordinance . The special use must comply with all regulations set
forth in the Zoning Code for the district in which the use is
located except those which have been specifically excepted under
this permit, and all other applicable ordinances of the City of
Cape Girardeau and any special conditions contained in the Special
Use Permit, a copy of which is attached hereto and incorporated
herein by refer_ ence . The City Manager is hereby given the power
to execute the Special Use Permit for and on behalf of the City of
Cape Girardeau , Missouri .
SECTIOI� 3 . This ordinance shall be in full force and effect
ten days after its passage and approval .

SPECIAL USE PERMIT
Keith H . Lee and Gail Lee are hereby granted a Special Use
Permit for purposes of constructing and maintaining a business
sign and for enlargement of the parking area, on the following
described property for an indefinite period of time:
A Part of Lot 6 of Pleasant Acres Subdivision in the
City and County of Cape Girardeau , Missouri (As shown
on Plat Book 5 , Page 11 ) , described as follows :
Commence at the Northwest corner of said Lot 6 ; thence
S . 8G° 00 ' E. , with the North line of said Lot 6 , 80 . 0
feet for the point of beginning; thence S . 4° 00 ' W. ,
109 . 0 feet to th� South line of said Lot 6 ; thence N .
77° 58 ' E. , with said South line , 133 . 6 feet to the
East corner of said Lot 6 ; thence N. 35° 20 ' �4. with

This Special Use Permit is granted upon the condition that the
Applicants be bound by all City Ordinances which pertain to the
Special Use Permit and that the Applicants be bound by the
following conditions which are imposed as a condition of issuance
of this Special Use Permit . Upon the failure of the Applicants to
comply with these special conditions , the Special Use Permit will
automatically terminate with the right of the City of Cape
Girardeau to enter_ upon the land to abate such special use .
SPECIAL CONDITIONS:
l . Additions or modifications from the original building
permit must be approved by the City Council .
2 . Special use shall meet all zoning regulations .
3 . The construc:tion and maintenance of a business sign shall
be in accordance with the drawing submitted by Applicants
which is marked Exhibit "A" and attached hereto and
incorporated herein by reference . The sign size is
specifically limited to 2 .7 feet in height and 4 . 2 feet
in length and the design and type ot sign shall be in
conformity with the information set forth in Exhibit "A" .
4 . The enlargement of the parking area shall be in
conforrnance with the drawing and information set out in
Exhibi;� "B" , which is attached hereto and made a part
hereof by reference which shows the dimensions and
location of a parking area .
