AN ORDINANCE ESTABLISHING THE BOUNDARIES OF
SEWER DISTRICT N0. 12-ZZ , A SUBDIVISION OF
SEWER DISTRICT N0. 12, APPROVING THE PLANS
FOR THE CONSTRUCTION OF A SYSTEM OF SANITARY
LATERAL SEWERS IN SEWER DISTRICT N0. 12-ZZ,
AND AUTHORIZING THE CONSTRUCTION OF SANITARY
LATERAL SEWERS IN SEWER DISTRICT N0. 12-ZZ
UNDER A PRIVATE CONTRACT SUBJECT TO CERTAIN
PROVISIONS, IN THE CITY OF CAPE GIRARDEAU,-
MISSOURI
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
SECTION 1 . That the boundar ies of Sewer Di str ict No . 12-Z Z , a
subdivision of Sewer District No . 12 in the City of Cape
Girardeau , Missouri , shall be as follows:
Part of the Fractional Northeast Quarter of Section
26 , Township 31 North , Range 13 East, of the Fifth
Principal Meridian, in the City of Cape Girardeau ,
Missouri , described as follows:
Begin at a sand stone on the East line of said Section
26 , from which a stone at the Northeast corner of said
Section 26, bears North 0° 03' 20" East, 2592 .5 feet ;
thence North 75 ' 31 ' 56" West, 437 .17 feet ; thence
South 4° 05' 06" West, 175 .91 feet to a point on the
South line of said Northeast Quarter ; thence North 89°
53' 21" West along said South line 3 .84 feet to an
intersection with the center line of Kingsway Drive;
thence Westerly along said center line on a curve to
the left having a radius of 911 . 40 feet a distance of
188 .52 feet ; thence South 88° 26 ' 46" West along said
center line 373. 95 feet ; thence along said center line
on a curve to the right having a radius of 256 . 88 feet
a distance of 193. 20 feet ; thence North 48° 27 ' 39"
West, 210 . 18 feet ; thence North 53° 18 ' 09" West , 70 . 0
feet to the intersection of said center line with the
East right-of-way line of State Route W; thence North
20° 31 ' 25" West along said right-of-way line 51 . 63
feet to a concrete right-of-way monument ; thence
Northerly along said right-of-way line on a curve to
the left having a radius of 558 . 34 feet a distance of
285 . 41 feet ; thence departing from said right-of-way
North 88° 06 ' East , 45. 43 feet ; thence North 88° 56 '
46" East, 953. 11 feet ; thence North 4° 08 '. 36" East,
208 .91 feet ; thence North 82° 43 ' East, 361 . 47 feet to
a point on the West line of Deborah Avenue; thence

South 0° 03' 20" West 157 . 3 feet to the intersection
of the West line of Deborah Avenue with the South line
of Melrose Avenue ; thence with the South line of
Melrose Avenue South 89° 40' East, 20 . 0 feet to the
intersection of the south line of Melrose Avenue with
the East line of Section 26 ; thence with said section
line South 0° 03 ' 20" West, 629 .5 feet to the point of
beginning.
SECTION 2. That the plans for the construction of a system of
sanitary lateral sewers to serve Sewer District No. 12-ZZ, a copy
of which is on file in the office of the City Clerk , are hereby
approved and ordered filed .
SECTION 3 . That the o��ners of lands in said Sewer District
No. 12-ZZ are hereby granted permission to construct said system
of sanitary lateral sewers in Sewer District No . 12-ZZ and to
connect same to existing sewers in Sewer District No. 12, subject
to the following provisions .
1 . That proper authority has been secured to proceed from
the Missouri Clean Water Commission.
2. That all permanent easements for said sewers on private
property are made to the City of Cape Girardeau ,
Missouri , prior to execution of a contract for the work
of construction of said sewers .
3. That all City ordinances, Standard Specifications of the
City and State laws applicable to this project will be
observed in all respects .
4. That the quality of the work and materials be inspected
by the agents of the City engineer of the said City, and
that cost of said inspections be paid to said City
following the completion of the work and its acceptance
by said City and the Missouri Clean Water Commission.
SECTION 4. That this Ordinance shall take effect and be in
full force from and after ten days following its passage and
approval .
