AN ORDINANCE AMENDING CHAPTER 16 OF THE CODE
OF ORDINANCES OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, BY REPEALING THOSE PROVISIONS
WHICH PROVIDE FOR GROSS RECEIPTS TAX ON
HOTELS , MOTELS AND RESTAURANTS
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
SECTION 1 . Chapter 16 of the Code of Ordinances of the City
of Cape Girardeau , Missouri , is hereby amended by repealing
Sections 16-190 , 16-191, 16-192, 16-193, 16-194, 16-195, 16-196
and 16-197 in their entirety thereby eliminating all provisions
for the imposition of any gross receipts tax on hotel , motels and
restaurants as was previously provided by those Sections of the
Code of Ordinances of the City of Cape Girardeau , Missouri .
SECTION 2. This ordinance shall take effect on November 1 ,
2004 and all of these sections of the Code of Ordinances herein
named shall continue in full force and effect until that date .
SECTION 3. This ordinance shall not become effective unless a
majority of the qualified voters of the City voting in the August
4 , 1987 special election approve the repeal of the present levy as
set forth in this ordinance . If a majority of such voters approve
the repeal of the tax levy, then this ordinance shall be in full
force and effect from and after November 1 , 2004.
SECTION 4. If any section, subsection, sentence, clause ,
phrase or portion of this ordinance is for any reason held invalid
or unconstitutional by any court of competent jurisdiction, such
portion shall be deemed a separate, distinct and independent
provision and such holding shall not affect the validity of the
remaining portions hereof.
SECTION 5 . It is the intention of the governing body and it
is hereby ordained that the provisions of this ordinance shall
become and be made a part of the Code of Ordinances of the City of
Cape Girardeau , Missouri , and the sections of this Code may be
renumbered to accomplish such intention .
