AN ORDZNANCE ESTABLISHING THE BOUNDARIES OF
LATERAL SEWER DISTRICT N0. 13-J, A SUBDIVISION OF
TRUNK SEWER DISTRICT N0. 13 , APPROVING THE PLANS
FOR THE CONSTRUCTION OF A SYSTEM OF SANITARY
LATERAL SEWERS IN SEWER DISTRICT N0. 13-J, AND
AUTHORIZING THE CONSTRUCTION OF SANITARY LATERAL
SEWERS IN SEWER DISTRICT N0. 13-J UNDER A PRIVATE
CONTRACT SUBJECT TO CERTAIN PROVISIONS, IN THE
CITY OF CAPE GIRARDEAU, MISSOURI
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI , AS FOLLOWS:
ARTICLE 1 . That the boundaries of Sewer District No. 13-J, a
subdivision of Trunk Sewer District No. 13 in the City of Cape
Girardeau, Missouri , shall be as follows :
A part of Outlot No . 52, United States Private Survey No .
2199 , Township 30 North, Range 14 East of the Fifth
Principal Meridian, City and County of Cape Girardeau,
State of Missouri , being more particularly described as
follows:
Beginning at a point on the North line of Outlot No. 52,
from which the Northeast corner of said Outlot No . 52 bears
South 81° 31 ' 50 ' East , 621 . 80 feet , said point also being
the North�aest corner of a tract of land recorded in the
land records of the County Recorders Office in Book No . 328
at Page No. 560 ; thence South 08° 34 ' 17" West , 594 . 86 feet
along the West line of said tract to the Southwest corner
of said tract ; thence South 81° 21 ' 41" East , 110 . 56 feet
along the South line of said tract ; thence South 08° O1 '
02" West, 245. 40 feet to the North right-of-way line of
Linden Street ; thence North 81° 23 ' 45" West , 771 . 74 feet
along said North right-of-way line of Linden Street to the
East right-of-way line of West End Boulevard; thence North
07° 49 ' 39" East , 364 . 15 feet along said East right-of-way
line to the centerline of Storm Water Channel S.D. No. 5 ;
thence along said centerline the following courses and
distances : North 48° 57 ' 54" East, 508. 18 feet ; thence
North 33° 58 ' 31" East , 97 . 71 feet to the North line of
Outlot No. 52 ; thence Sout� 81° 31 ' S0" East , 292. 30 feet
along said North line to the point of beginning containing
11 . 23 acres more or less .
ARTICLE 2. That the plans for the construction of a system of
sanitary lateral sewers to serve Sewer District No. 13-J, a copy
of which is on file in the office of the City Clerk, are hereby
approved and ordered filed .
ARTICLE 3 . That the owners of lands in said Sewer District
No. 13-J are hereby granted permission to construct said system of
sanitary lateral sewers in Sewer District No. 13-J and to connect
same to existing sewers in Trunk Sewer District No. 13, subject to
the following provisions .
1 . That proper authority has been secured to proceed from
the Missouri Clean Water Commission.
2 . That all permanent easements for said sewers on private
property are made to the City of Cape Girardeau,
Missouri , prior to execution of a contract for the work
of construction of said sewers .
3o That all City Ordinances, Standard Specifications of the
City and State laws applicable to this project will be
observed in all respects .
4 . That the quality of the work and materials be inspected
by the agents of the City engineer of the said City, and
that cost of said inspections be paid to said City
following the completion of the work and its acceptance
by said City and the Missouri Clean Water Commission.
ARTICLE 4 . That this Ordinance shall take effect and be in
full force from and after ten days following its passage and
approval.
