BILL N0. 89-121 ORDINANCE N0. ��
AN ORDINANCE VACATING THE CITY' S INTEREST IN A
SEWER EASEMENT IN PARK WEST PROFESSIONAL PLAZA,
IN THE CITY OF CAPE GIRARDEAU, MISSOURI
WHEREAS, the City Council has received a request that the City
vacate a sewer easement in Park West Professional Plaza and more
particularly described in Section 1 hereof ; and
WHEREAS, the City Council has determined that the sewer
easement in question is not necessary or needed for any of the
purposes for which it was dedicated and established; and
WHEREAS, it is in the public interest that the easement be
vacated;
NOW, THEREFORE, BE IT ORDAINED BY TAE COUNCIL OF THE CITY OF
CAPE GIRARDEAU, MISSOURI , AS FOLLOWS :
SECTION 1 . The City's interest in the sewer easement on the
following described real estate:
Part of Outlot 83, U. S . P. S. 2199 , Township 30 North, Range
13 East in the City and County of Cape Girardeau, Missouri ,
being also in Lots 15 , 17 , and 18 of First Park West
Professional Plaza and more particularly described as
follows :
Start at the intersection of the East line of said Outlot
83 and the North right-of-way line of Independence Street ,
which is also the Southwest corner of Crites First
Addition; thence South 89° 56 ' West , 5 . 05 feet along said
right-of-way to a point; thence South 8° 17 ' West, 21 . 2
feet ; thence South 38° West , 71 . 2 feet ; thence South 44°
42 ' West, 4 . 2 feet to a point on the South right-of-way of
Independence Street for a point of beginning of the
centerline of a 10 foot wide sewer easement; thence
continuing South 44° 42 ' West, 31-9 . 9 feet to a point ;
thence South 49° 11 ' West, 178 . 78 feet to the North line of
a 15 foot wide drainage and sewer easement between Lots 14
and 15 of First Park West Professional Plaza and there
terminating .
Excluding any portion within the established right-of-way
of Silver Springs Road.
is hereby vacated .
SECTION 2 . This ordinance shall be in full force and effect
ten days after its passage and approval .
