AN ORDINANCE CALLING A SPECIAL ELECTION IN THE
CITY OF CAPE GIRARDEAU, MISSOURI , ON THE QUESTION
WHETHER THE CITY SHALL ANNEX CERTAIN LANDS
LOCATED NORTHEAST OF THE INTERSECTION OF HIGHWAY
61 AND INTERSTATE HIGHWAY 55 IN CAPE GIRARDEAU
COUNTY; DESIGNATING THE TIME OF HOLDING THE
ELECTION; AUTHORIZING AND DIRECTING THE CITY
CLERK TO GIVE NOTICE OF THE ELECTION; AND
DECLARING AN EMERGENCY TO EXIST
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI , AS FOLLOWS:
SECTION l . A special election is hereby ordered to be held in
the City of Cape Girardeau, Missouri , on Tuesday, August 8 , 1989 ,
on the following question:
QUESTION
Shall the municipality of Cape Girardeau, Missouri , annex
certain lands located Northeast of the intersection of
Highway 61 and Interstate Highway 55 in Cape Girardeau
County as authorized by a judgment of the Circuit Court
of Cape Girardeau County, Missouri , entered May 22, 1989?
The lands proposed for annexation are the Cape Girardeau
County Farm Park ( 85 . 85 acres ) ; lands owned by Victorian
Inns , Inc ./Midamerica Hotels Corporation ( 70 . 09 acres ) ;
and smaller tracts owned by James L. and Wanda L. Drury
and Union Electric Company.
SECTION 2. The form of the notice of election for the special
election, a copy of which is hereby attached and made a part
hereof , is hereby approved.
SECTION 3 . The City Clerk is hereby authorized and directed
to notify the County Clerk of Cape Girardeau County, Missouri , of
the passage of this ordinance no later than 5 : 00 o' clock P. M. on
June 13 , 1989 , and to include in the notification all of the terms
and provisions required by the Comprehensive Election Act , Chapter
115 , Missouri Revised Statutes , 1978 , as amended.
SECTION 4. It is hereby found and declared that an emergency
exists as provided for in Section 3 . 15 of the City Charter of the
City of Cape Girardeau, Missouri , in that the election authority,
under the time of notice provision set forth in Section 115 . 125 ,
Missouri Revised Statutes , 1978 , as amended, must be notified not
later than 5 : 00 o ' clock P.M, on June 13 , 1989 , of an election to
be held on August 8 , 1989 . It is hereby further found and
declared that calling an election and providing for 'the submission
of a proposal to the people is an emergency measure as provided in
Section 3 . 15fd) of the City Charter of the City of Cape Girardeau,
Missouri .
SECTION 5. This ordinance shall be in ful�l force and effect
from and after its passage and approval .

CITY OF CAPE GIRARDEAU , MISSOURI
Notice is hereby given to the qualified voters of the City of
Cape Girardeau, Missouri , that the City Council of the City has
called a special election to be held in the City on August 8 ,
1989 , commencing at 6 : 00 o ' clock A.M. and closing at 7 : 00 o ' clock
P. M. on the question contained in the following sample ballot :
