AN ORDINANCE VACATING THE CITY' S INTEREST IN
A STORM DRAINAGE EASEMENT IN CEDAR RIDGE
SUBDIVISION, IN THE CITY OF CAPE GIRARDEAU,
MISSOURI
WHEREAS, the City Council has received a request from Robert
Penrod that the City vacate a storm drainage easement on property
owned by him in Cedar Ridge Subdivision and more particularly
described in Section 1 hereof ; and
WHEREAS , the City Council has determined that the storm
drainage easement in question is not necessary or needed for any
of the purposes for which it was dedicated and established; and
WHEREAS, it is in the public interest that the easement be
vacated;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THF CITY OF
CAPE GIRARDEAU, MISSOURI , AS FOLLOWS:
SECTION l . The City' s interest in the storm drainage easement
on the following described real estate :
An easement being part of Lots 16 and 23 in Cedar Ridge
Subdivision in the C.ity of Cape Girardeau, Missouri , more
particularly described as follows:
Begin at the Southeast corner of Lot 16 of Cedar Ridge
Subdivision; thence North 28° West along the East line of
said Lot 16 prolonged to the South line of a 25 foot wide
easement along the North side of Lot 23 ; thence South 88°
56 ' 46" West , 5 . 61 feet ; thence South 28° East parallel to
the East line of Lot 15 prolonged to the South line of said
Lot 16 ; thence North E2° East , 5 . 0 feet to the point of
beginninq and there terminating .
is hereby vacated.
SECTION 2 . This ordinance shall be in full force and effect
ten days after its passaqe and approval .
