AN ORDINATICE REPEALING SECTION 25-63 (b ) OF
THE CITY CODE SUBDIVISION REGULATIONS AND
ENACTING A NEW SECTION 25-63 ( b ) IN LIEU
THEREOF RELATING TO DOUBLE FRONTING LOTS
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU ,
MISSOURI , AS FOLLOWS:
SECTION 1 . Section 25-63 entitled "Single-family residential
lot design standards " is nereby amended by repealing paragraph (b )
pertaining to lots with double frontage and enacting in lieu
thereof a new paraqraph (b ) pertaining to lots with double
frontage , in words and fiaures as follows , to-wit :
Sec . 25-63 . Single-family residential lot design standards .
(� ) Lots with double frontage should be avoided, except
where necessary to provide separation of the
subdivision from traffic arteries , or as otherwise
required by topography or similar conditions . In
approving double fronting lots the Council may require
the developer to create deed restrictions to limit
access 'to one street or the other .
SECTION 2 . If any section , subsection, sentence , clause ,
phrase or portion of this ordinance is for any reason held invalid
or unconstitutional by any court of competent jurisdiction , such
portion shall be deemed a separate , distinct and independent
provision and such holding shall not affect the validity of the
remaining portions hereof .
SECTION 3 . It is the intention of the governing body and it
is hereby ordained that the provisions of this ordinance shall
become and be made a part of the Code of Ordinances of the City of
Cape Girardeau , Missouri , and the sections of this Code may be
renumbered to accomplish such intention .
SECTION 4 . This ordinance shall be in full force and effect
ten days after its passage and approval .
