AN ORDINANCE RELATING TO LOCAL EMERGENCY
MANAGEMENT FOR THE CITY OF CAPE GIRARDEAU,
MISSOURI
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI , AS FOLLOWS :
ARTICLE 1 . Sections 9-1 through 9-6 , inclusive, and 9-17
through 9-21, inclusive, of the Code of Ordinances of the City of
Cape Girardeau, Missouri , all pertaining to "Civil Defense" , are
hereby repealed in their entirety, and the following new Sections
to become part of Chapter 9 of the Code of Ordinances of the City
of Cape Girardeau, Missouri , relating to "Emergency Management and
Disaster Planning" are hereby enacted, in words and figures as
follows, to-wit :
CHAPTER 9 .
EMERGENCY MANAGEMENT AND DISASTER PLANNING
ARTICLE I . EMERGENCY PLANNING
Sec. 9-1. Establishment .
There is hereby created an emergency management
organization for the City of Cape Girardeau, Missouri ,
which is responsible for the preparation and implementation
of emergency functions required to prevent injury and
minimize and repair damage due to disasters, to include
emergency management of resources and administration of
such economic controls as may be needed to provide for the
welfare of the people, arid emergency activities in
accordance with Chapter 44 , Revised Statutes of Missouri ,
and supplements thereto, and the Missouri Emergency
Operations Plan adopted thereunder .
Sec. 9-2 . Organization.
The emergency management organization for the City of
Cape Girardeau, Missouri , shall consist of a Director , who
shall be appointed by the City Manager of Cape Girardeau
and other members appointed by the City Manager to conform
to the State organization and procedures for the con�uct of
emergency operations as outlined in the Missouri Emergency
Operations Plan .
Sec. 9-3 . Director .
The Director shall have the direct responsibility for
the organization, administration and operation of the
Management Organization for the City of Cape
Girardeau, Missouri , I will not advocate nor become
a member of any political party or organization that
advocates the overthrow of the government of the
United States or of this State by force or violence. "
Sec. 9-6 . Office Space.
The City Manager is hereby authorized to designate
space in any building owned or leased or otherwise occupied
by the City as the official Cape Girardeau Emergency
Operations Center .
ARTICLE 2 . If any section, subsection, sentence, clause,
phrase or portion of this ordinance is for any reason held invalid
or unconstitutional by any court of competent jurisdiction, such
portion shall be deemed a separate, distinct and independent
provision and such holding shall not affect the validity of the
remaining portions hereof .
ARTICLE 3 . It is the intention of the governing body and it
is hereby ordained that the provisions of this ordinance shall
become and be made a part of the Code of Ordinances of the City of
Cape Girardeau, Missouri , and the sections of this Code may be
renumbered to accomplish such intention.
ARTICLE 4 . Pursuant to Section 3 . 15 of the Charter of the
City of Cape Girardeau , Missouri , this measure is adopted as an
emergency measure as it constitutes a Bill concerning the
immediate preservation of public peace, property, health, safety
or morals . Accordingly, this ordinance will take effect
immediately upon its passage and approval .
