AN ORDINANCE REAFFIRMING THE ACTION OF THE CITY COUNCIL
DECLARING IT NECESSARY TO IMPROVE , PROVIDING FOR THE
IMPROVEMENT, DIRECTING THE CITY MANAGER TO ENTER INTO A
CONTRACT TO DO THE WORK , PROVIDING FOR THE PAYMENT OF
THE WORK , AND PROVIDING FOR THE ISSUANCE OF SPECIAL TAX
BILLS IN AN AMOUNT NOT TO EXCEED �25 , 00 PER FRONT FOOT
IN PAYMENT OF THE COST OF SAME OP� THAT PART OF LEXINGTON
AVENUE FROM A POINT 302, 71 FEET WEST OF THE EAST
RIGHT-OF-WAY LINE OF FLAD AVENUE TO A POINT 47 , 6 FEET
WEST GF THE CEN'TERLINE OF CP.ROLINA LANE , A DISTANCE OF
1537 . 51 FEET, WITH THE BALANCE TO BE PAID FROM GENERAL
REVENUE FUNDS , IN THE CITY OF CAPE GIRARDEAU , MISSOURI
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU ,
MISSOURI , AS FOLLOWS:
ARTICLE l . That the City Cauncil of the City of Cape
Girardeau , Missouri , has by resolution in writinq duly adopted at
�a reaular meeting of said Council held cn June 19 , 1989 , found and
'declared it ta be necessary to improve that part of Lexinaton
Avenue from a point 302 . 71 feEt West of the East right-of-way line
of Flad Avenue to a pcint 47 . 6 feet ���est of the centerline of
Carolina Lane , a dis�ance of 1537 , 51 feet , by qraCinq to the
established qra�e and censtructinq thereon an Asphaltic Cement
Pavement 9 inches thick and 44 feet in width between the backs of
combined concrete curbs and gutters � excep� at the various
intersecting streets , where the pavement shall be constructed as
shown on the plans for saic imprcvemen� , the to}al distance of
said improvement to be approximately 1537 .51 feet , and along with
prcper�y subject to assEssmen} for said improvement totals
approximately 2818 .59 feet . Said resolution further provided that
�he said work of the improvement should be done by con�ract as
provided by law and ordinance and further provided }hat the cost
of the proposed work , not to exceed �25 . 00 per front foot shall be
charqed to the abuttinq pr �perty by the issuance of special tax
bills and the balance shall be charged to the City and any cost in
excess cf �25 .00 per fron: foo� shall be borne by thE general
revenue funcl of the City and only �25 . 00 per front foot shall be
chargeci against the abuttinq property , all in accordance with
Chapter 88 , RSMo 1978 , and such ordinances as may be hereafter
enacted to carry out said work ,
ARTICLE 2 . That the Council finds and declares that the
resolution has been published in the Southeast Missourian , a daily
newspaper printed and published in '�he City of Cape Girardeau ,
Missouri , for seven ( 7) consecutive issues , and that anyone
desiring to appear before the Council and be heard on �he question
of the necessity of :he work to be done was allowed to do so and
tha� the Council has , by Resolution , stated the result cf the
hearing to be a reaffirmance of the necessity of the improvement
,
of Lexinqton AvEnue frcm a poin� 302 . 71 feet P�est of the East
righ�-of-way line of Flad Avenue to a point 47 .6 feet West of the
cen�erline of Carolina! Lane , a distance of 1537 . 51 feet , as
proposed in the Resolution of Necessity .
ARTICLE 3 . That the Council further finc�s that all
requiremen�s imposed by law and ordinance for the improvement have
been complied with and that it thereby acquirEd authority to order
the improvement and now hereby orders and directs tha� that part
of Lexinqton Avenue from a point 302 , 71 feet West of the East
right -of-way line of Flad Avenue to a point 47 . 6 fEet West of the
cen:erline of Carolina Lane , a distance of 1537 , 51 feet be
improved� by qradinq to the established qrade and constructing
thereon an Asphal �ic Cement Pavement 9 inches thick and 44 feet in

excep� at the various intersectinq streets , all in accordance with
the plans and specifications for the improvement previously
adopted and on file in the Office of the City Clerk , in accordance

ARTICLE 4 , That the Prevailinq Hourly Waqe Rate as determined
by the Department of Labor and Industrial Relations for the public
works project in Waqe Determ.ination No . 89- 016- 0040 , is attached
hereto and �rade a part of this ordinance by refErence . ThE City
of Cape Girarceau is authorized to con�ract for this public works
projec� with a contractor who will pay his workmen the prEvailing
hourly rate of wages for each type of workrr�an as deterrr:ined in
Waae De�ermination No . 89-016-0040 , who will aqrEe to comply with
all provisions of the Prevailinq Waqe Law , and who is not
prohibited by the provisions of :he Prevailing Waqe Law from
contracting with the City on a public works project .
ARTICLE 5 . The Council further orders and directs that �he
work of imprcvement of that part of Lexinqton Avenue above
described, be done by contract , and that it be done so that it
will in all respects comply with �he said plans and specifications
therefor � and that the cost thereof will not exceed the estimate
of cost for said work on file in �he Office ef the City Clerk and
heretofore apprcved by the council , excep} such items of work
necessary to �he proper construction of the improvements and
unforeseen and not included in the es: imate of cost , and said work
of improvement shall be done in such manner as to comply with all
applicable statutes and ordinances . The contrac: entered into
shall not be in excess of the estimates of the whole cost of the
improvement previously made and above referred to , The Council
further fincs and declares that the condition of the general
revenue fund of the Ci '�y is such that the pertion of the cost of
the work in excess of �25 .00 per front foot shall ultimately be
paid therefrom.
ARTICLE 6 , The City Manager of �he City of Cape Girardeau is
hereby authorized and directed to enter into a contract for the
City with Nip Kelley Equipment Co . , Inc . , for such improvement in
accordance with the law and ordinances of the City , said contract

shall provide that such work of improvement shall be done in
accordance with the plans, specifications, estimate of cost, and
this ordinance .
ARTICLE 7 . The contract shall provide that the payment to the
Contractor shall be made from the general revenue fund of the City
with monthly estimates to be paid to the contractor for work
completed , less ten per cent ( 10% ) retainage . Final payment is to
be made within ten ( 10 ) days of final acceptance of the work by
the City . G7hen the work of improvement has been completed as
herein provided and has further been approved by the City Engineer
in a written report thereof , an� when said report has been
approved and adopted by the City Council , and the cost of the work
shall initially have been paid for by the City, special tax bills
in an amount not to exceed �25 . 00 per front foot shall be issued
in favor of the City of Cape Girardeau and against the lots ,
tracts and parcels of land fronting and abutting on said
improvement along the distance mentioned , in proportion to the
number of front feet fronting or abutting on said portion of the
street so improved and in accordance with the law, and which said
special tax bills shall be delivered to the City of Cape
Girardeau . Such special tax bills shall bear interest from sixty
( 60 ) days after their date at eight and seventy-seven one
hundredths per cent ( 8 . 77� ) per annum .
ARTICLE 8 . This ordinance shall take effect and be in force
from and after ten days after its passage and approval .

In eccordance with your request for the prevailing hourlp rate of wages for
workmen required to perform the project or construction contract identified in
your request, and pursuant to Section 290.210 to 340 V.A.t1.S. , the Division of
Labor Standards, being duly informed and havi.ng fully considered the matter,
finds, determines, declares, and certifies to you and the public body you repre-
sent:
l. That the "Prevailing Hourly rate of wages" mea.*�s the wages paid general-
?;, in the lo�elity in �?hicn the public works is bein� oerformed, to work-
men engaged in work of a similar cnaracter including the basic hourly rate
of pay and emount of the rate of contribu�ions irrevocably made by a con-
tractor or subcontractor to a trustee or to a third person pursuant to a
fund, plan or prograa and the amount of the rate of� cost to the contractor
or subcontractor whic�i may be reasonably anticipated in �roviding benefits
to workmen and mechanics pursuant _to an enforceable comnitoent to carry out
a finencially responsible plan or program which was communicated in writing
to the workmen affected, for medical or hospital care, pensions on retire-
ments or 'death, compensation for injuries or illness resulting from occup a-
tional activity or insurance to provide any of the foregoing, for unemploy-
ment benefits, �ife insurance, disability and sickness insurance, accident
insurance, for vacation and holiday pay, for defraying cost of apprentice-
ship or other similar programs, or for other bona fide frin,�e bene=its , but
only where the contractor or subcontractor is not required by other federal
or state law to provide any of the beneiits; provided, that the obligation
of a contractor or subcontractor to make payment in accordance with the
prevailing wage determi.nation of the department, insofar as sections
Z90.210 to 290.340 are concerned, may be discharged by the making of pay-
ment in cash, by the making of irrevocable contributions to trustee or
third persons, as provided herein, by the assumption of an enforceable
commitment to bear costs of a plan or program as provided herein, or any
combination thereof, where the aggre�ate ofluscthego•thersamountslastp�ovid-
ar�d cost is not less than the rate ot pay p
ed herein.
2. That certified copies• of this determination will be filed imnediately .
with the Secretary of the State of Missouri and in the files of this depart-
ment. .
The Division is not authorized to f ix wage rates. The applicable law allows it
to onlv as�e:tain what in fact� are the �revailing hourly wages for a given
craft in a given locality. � A � Locality�� is the county or counties where the
�roject is to be constrvcted. The law provides that not less than the prevail-
ing hourly wages determined by the Division shall be �aid by a contractor or
subcontractor. A higher wage rate may be lawfully paid.
Should ob'ections be filed to any portion of this determination, such obJ'ection
or object�ons must be specific and filed in accordance with Section 290.260 of
the Prevailing Wage Law.

OVERTL'� RATE: Wor�en shall be paid one � one-half (1'�) times Lhe regular rate of wages
for all hours vorked in excess of eight (8) houzs per day (if- vorking S-8's) > or ten (10)
hours per day (if vorking 4-IO's) ,, or forty. (40) hours per �reek, Honday through Friday.
For all time vorked on Saturday (unless Saturday is used as a• make-up day) or Sunday,
time � one-�alf (1�) shall be paid. �
