AN ORDINANCE AMENDING CHAPTER 13 OF THE CODE OF
ORDINANCES OF THE CITY OF CAPE GIRARDEAU RELATING
TO STORAGE, COLLECTION, TRANSPORTATION,
PROCESSING P.ND DISPOSAL OF SOLID WASTE
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CP.FE GIRARDEAU,
MISSOURI , AS FOLLO��S:
ARTICLE 1 . Section 13- 11 of the Ccde of Ordinances cf the
City of Cape Girardeau , Missouri , entitled "Definitions " is hereby
amenGed in 'tne following respects :
The definition of Commercial Establishment is hereby
repealed and a new definition of Commercial Estabiishment is
hereby enacted in lieu thereof , in words and figures , as foilows ,
to-wit :
Commercial Establishment : Any commercial, industrial ,
institutional or agricultural establishment , and any
multiple housinq facility or multiple housing complex witri
more than three ( 3) dwelling units .
ARTICLE 2 . Section 13-11 of the Code of Orcinances of the
City of Cape Girardeau , Missouri , entitled " Definitions " is hereby
amended by regealing the definition of Solid Waste and enacting in
lieu thereof , a new cefinition af Solid b�aste , in words and
figures , as follows , to-wit :
Solid �Jaste : Unwanted cr discarded waste materials in a
solid or semisolid sta'te , including but not limited tc
garbage , ashes , street refuse , rubbish , dead animals ,
animal and aqricultural wastes , yard wastes , discarded
appliances , special wastes , industrial wastes , and
demolition anc ccnstruction wastes .
(a ) Commercial solid waste: Solid wGs'te resulting
irom tne operation of any commerciai , indus�rial ,
instituticn�l or aqricultural establishment , and
any multiple housing facilities with mcre than
three ( 3) dwelling units , or multiple housing
complexes with more than three ( 3) dwelling units .
(b ) Residential solid waste: Solid waste resulting
from the maintenance and operating of dwelling
units , excluding multiple housinq facilities with
more than three ( 3) dwelling units , and multiple
housing coMplexes with more than three ( 3)
dwelling units .
ARTICLE 3. If any section , subsection , sentence , clause ,
phrase or portion of this ordinance is for any reason held invalid
or unconstitutional by any court of competent jurisdiction , such
portion shall be deemed a separate , distinct and independent
provision and such holding shall not affect the validity of the
remaining portions hereof .
ARTICLE 4 . It is the intention of the governing body and it
is hereby ordained that the provisions of this ordinance sha? 1
become and be made a part of the Code of Ordinances of the City of
Cape Girardeau , Missouri , and the sections of this Code may be
renumbered to accomplish such intention .
ARTICLE 5. This ordinance shall be in full force and effect
ten days after its passaqe and approval .
