(� AN ORDINANCE AMENDING CHAPTER 30 OF THE CITY CODE BY AMENDING SECTION 30-21 , ENACTING A NEW SECTION 30-31 . 2, AND AMENDING SECTION 30-38 ( C) RELATING TO "A-1 " , AIRPORT INDUSTRIAL DISTRICT REGULATIONS BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU, MISSOURI , AS FOLLOWS : ARTICLE l . Section 30-21 of the Code of Ordinances of the City of Cape Girardeau, Missouri , is hereby amended by repealing a portion of Section 30-21 , in words and figures , as follows, to-wit : Sec . 30-21 . District and boundaries thereof . In order to classify, regulate and restrict the location of trades , residences , and the locations of buildings designed for specific uses , to requlate and limit the height and bulk of buildinqs hereafter erected or structurally altered, to requlate and limit the intensity of the use of the lot areas , and to regulate and determine the areas of yards , and other open spaces within and surrounding such buildings , the City of Cape Girardeau , I�issouri , is hereb_y divided into districts of which there shall be eleven in number , known as : "R-1 " Single-Famil _v Dwellinq District "R-2" Sinqle-Family Dwelling District "R-3" Two-Family Dwelling District "R-4" Multiple Dwelling District "MH-1 " P4obile Home Park District "C-1 " Local Commercial District "C-2" General Commercial District "C-3" Central Business District "C-4" Planned Commercial District "P1-1 " Liaht Industrial District "M-2" Heavy Industrial District ARTICLE 2. Section 30-21 of the Code of Ordinances of the City of Cape Girardeau , Missouri , is hereby amended by enacting a new portion of Section 30-21 , in words and figures , to read as follows , to-wit : Sec . 30-21 . District and boundaries thereof . In order to classify , regulate and restrict the location of trades , residences , and the locations of buildings designed for specific uses, to regulate and limit the heiqht and bulk of buildings hereafter erected or structurally altered , to regulate and limit the intensity of the use of the lot areas , and to regulate and determine the areas of yards , and other open spaces within and surrounding such buildings , the City of Cape Girardeau , Missouri , is hereby divided into districts of which there shall be twelve in number , known as: "R-1 " Sinqle-Family Dwelling District "R-2" Single-Family Dwelling District "R-3" Two-Family Dwelling District "R-4" Multiple Dwelling District "MH-1 " Mobile Home Park District "C-1 " Local Commercial District "C-2" General Commercial District "C- 3" Central Business District "C-4" Planned Commercial District "M-1 " Liqht Industrial District "M-2" Heavy Industrial District "A-1" Airport-Industrial District ARTICLE 3. Chapter 30 of the Code of Ordinances of the City of Cape Girardeau, Missouri , is hereby amended by adding a new Section 30- 31 . 2 entitled " "A-1 " Airport-Industrial District Regulations " , in words and figures, to read as follows, to-wit : Sec. 30-31 . 2. "A-1 " Airport-Industrial District Regulations . The regulations set forth in this section or set forth elsewhere in this ordinance when referred to in this section, are the regulations in the "A-1 " Airport-Industrial District . ( A) Use regulations . A building or premises shall be used only for the following purposes: ( 1 ) Public airport owned and/or operated by a general or special purpose unit of government, to include all air-side support facilities necessary for such operation . ( 2) General commercial aviation, air charter service , aircraft maintenance, pilot training , and scheduled air passenger and freight service . ( 3) Motor fuel filling , dispensing and/or storage for vehicles and aircraft . ( 4) Automobile and aircraft parking and storage . ( 5) Aircraft and aircraft-parts repair , reconstruction, construction or manufacture . ( 6) Agricultural use , limited to row crop production and excluding the raising of trees or animals , subject to applicable F. A. A, regulations . -2- ( 7) Parks , playqrounds and qolf courses . ( 8) Offices and office buildinqs . ( 9) Hotel or motel . ( 10) General retail sales , only with special use permit . ( 11 ) Food service , including restaurants and food dispensing . ( 12) Advertisinq siqns , limited to on-premise siqns advertising the name and services of a business located in the "A-1 " District . ( 13) Any siqn erected and maintained pursuant to and in the discharge of a governmental function or required by law, ordinance, or a qovernmental regulation . ( 14 ) Billboards , but only in conformance with Section 30-40 of this Ordinance . ( 15) Warehousing . ( 16) Any use permitted in the "M-1 " Light Industrial and "M-2" Heavy Industrial Districts , only with special use permit . (B) Height , area and bulk regulations . The height and area regulations set forth in Sections 30-35 and 30-36 shall be observed . ( C) Parking and loading regulations . Off-street parking and loading spaces shall be provided in accordance with the requirements for specific uses set forth in Section 30-37 . ARTICLE 4 . Section 30-38( C) entitled "Special Uses " , of the Code of Ordinance of the City of Cape Girardeau, Missouri , is hereby amended by repealing subparagraph ( 1 ) and enacting in lieu thereof a new subparagraph ( 1 ) , in words and fiqures , to read as follows , to-wit : Sec. 30-38 . Special use regulations . ( C) Special uses . ( 1 ) Public or private landing field, landing strip, helicoper landing pad , heliport or other landing area for all forms of aircraft ; auto race track and draq strip . -3- ARTICLE 5 . Section 30-38( C) entitled "Special Uses " , of the Code of Ordinances of the City of Cape Girardeau , Missouri , is hereby amended by repealing subparagraph ( 26) related to helicopter pads . ARTICLE 6 . If any section , subsection, sentence , clause , phrase or portion of this ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holdinq shall not affect the validity of the remaining portions hereof . ARTICLE 7 . It is the intention of the governing body and it is hereby ordained that the provisions of this ordinance shall become and be made a part of the Code of Ordinances of the City of Cape Girardeau , Missouri , and the sections of this Code may be renumbered to accomplish such intention .
