BILL N0. 90-30 ORDINANCE N0. 4 ��
AN ORDINANCE VACATING THE CITY' S INTEREST IN A
PORTION OF PAMELA DRIVE RIGHT-OF-bdAY IN 6�100DLAND
HILLS ESTATES FIFTH SUBDIVISION, IN THE CITY OF
CAPE GIRARDEAU, MISSOURI
G�HEREAS, the City Council has received a request from P. David
Gerlach for Randol Farms Realty Company that the City vacate a
portion of Pamela Drive right-of-way in Woodland Hills Estates
Fifth Subdivision, and more particularly described in Section 1
hereof ; and
WHEREAS, the City Council set the date of February 20, 1990
for a public hearing on this request ; and
WHEREAS, at least ten ( 10) days notice of the time and place
of this hearing was published in a newspaper of general
circulation in the City ; and
WHEREAS, a public hearing was held on February 20, 1990 at
which all interested parties were afforded the opportunity to
speak in favor of or in opposition to the proposed street
right-of-way vacation; and
WHEREAS, the City Council has determined that the street
right-of-way in question is not necessary or needed for street
purposes for which it was dedicated and established ; and
WHEREAS, it is in the public interest that the street
right-of-way be vacated ;
N04J, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
CAPE GIRARDEAU, MISSOURI, AS FOLLOWS: �F
ARTICLE 1 . The City ' s interest in street right-of-way on the
following described real estate:
A part of Pamela Drive as dedicated by the plat for
Woodland Hills Estates 5th Subdivision for street purposes
in the City and County of Cape Girardeau, more particularly
described as follows:
Begin at the most Southern point of the centerline for said
Pamela Drive as platted and dedicated in said subdivision,
being a right-of-way 50 feet wide measured perpendicular to
said centerline; thence Northerly and Easterly along said
centerline 59 . 81 feet and there terminating.
is hereby vacated.

ARTICLE 2 . This ordinance shall be in full force and effect
ten days after its passage and approval .
