AN ORDINANCE ACCEPTING A PERMANENT RIGHT OF WAY
EASEMENT AGREEMENT FROM AMOCO OIL COMPANY FOR THE
INTERSECTION OF ROUTE K AND SOUTH KINGSHIGHWAY
PROJECT
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI , AS FOLLOWS :
ARTICLE l . The City of Cape Girardeau, Missouri , hereby
accepts a Permanent Right of Way Easement Agreement executed by
Amoco Oil Company, a Maryland Corporation, conveying to the City
of Cape Girardeau, Missouri , an easement for the intersection of
Route K and South Kingshighway Project , more particularly
described as follows, to-wit :
All that part of grantor ' s land in Outlot No . 87 , U. S. P. S.
No . 2199, T. 30 N. , R. 13 E. in Cape Girardeau County,
Missouri , lying Northeast of and adjoining the existing
Highway right of way at the intersection of Routes 34
(William Street ) , 34 ( 61 ) and K within widths as
hereinafter designated from the following described highway
centerlines containing 213 square feet of new right of way.
The highway centerline of State Route 34 ( 61 ) is located and
described by commencing at the common corner of Outlots 57,
58 , 81 and 87 U. S. P. Survey No . 2199, T. 30 N. , R, 13 E. ,
in the City and County of Cape Girardeau, Missouri ; thence
N. 83° 44 ' ��d. 664. 22 feet to a point in the highway
centerline of State Route 34 ( 61 ) being Station 1122+38 . 6
for the point of beginning ; thence the highway centerline
of State Route 34( 61 ) extends S. 11° 00 ' W. 616 . 3 feet to
Station 1128+54 . 9 being the common point and intersection
of highway centerlines of Route 34( 61 ) , Route K and 34
(�9illiam Street ) .
The highway centerline of State Route 34 (William Street )
is located and described by commencing at Station 1128+54 . 9
on the above described highway centerline of State Route
34( 61 ) which is equal to State Route 34 (William Street )
Station 346+69 . 09 for the point of beginning ; thence the
highway centerline of Route 34 (William Street ) extends S.
84° 05 ' E. 130 . 91 feet to Station 348+00 .
Widths of new right of way as measured at right angles from
the above described highway centerlines are as follows :
On the East side of Route 34( 61 ) highway centerline, all
grantor ' s land lying within a tract that widens in a

straight line from a width of 105 feet at Station 1127+60
to a width of 110 feet at Station 1127+60 ; thence continues
a constant and uniform width of 110 feet from Station
1127+60 to Station 1127+90 ; thence widens Southeasterly in
a straight line from said width of 110 feet at Station
1127+90 to a point being 50 feet as measured from the North
side of Route 34 (William Street ) highway centerTine at
Station 347+99 .
Also, a permanent easement to construct and maintain a box
culvert for drainage across the following tract of
grantor ' s land containing 477 square feet is described as
being that part of Outlot 87, U. S. P. S. No. 2199, T. 30 N. ,
R. 13 E. , lying adjacent to and adjoining the above
described permanent high�aay right of way within widths as
measured at right angles from the above described highway
centerlines as follows : On the East side of Route 34( 61 )
highway centerline said easement widens in a straight line
from 0. 0 feet wide at a point 110 feet opposite Station
1127+60 to 15 feet wide at a point 125 feet opposite
Station 1127+60 ; thence widens Southeasterly in a straight
line to a point being 50 feet as measured from the North
side of the highway centerline of Route 34 (William Street )
at Station 347+99 .
Said permanent easement is to be used for the needed room
for men and machinery to work and turn on in the
construction of a box culvert . After the completion of the
construction of the box culvert , the owners of said land
may fence, and shall have the free and uninterrupted
possession and use of said tract ; subject only to the
Second Party ' s right , if it should so elect , to enter
thereon from time to time for the purpose of maintaining
said box culvert along oaith the needed work to insure
proper drainage .
ARTICLE 2. This ordinance shall be in full force and effect
ten days after its passage and approval .
