AN ORDINANCE ACCEPTING TEMPORARY CONSTRUCTION
EASEMENTS FROM DONALD CALDWELL AND LINDA
CALDWELL; JUDITH OLIVER; FRANK D. BEAN AND
MARY ELLEN BEAN; AND SHIRLEY STATLER GROJEAN,
DAVID GROJEAN AND CATHY STATLER, FOR THE
LEXINGTON AVENUE EXTENSION PROJECT IN THE CITY
OF CAPE GIRARDEAU, MISSOURI
ARTICLE l. The City of Cape Girardeau, Missouri, hereby
accepts a Temporary Construction Easement executed by Donald
Caldwell and Linda Caldwell, husband and wife, conveying to the
City of Cape Girardeau, Missouri, a Temporary Construction Easement
for the Lexington Avenue Extension Project, more particularly
described as follows, to-wit:
Al1 of that part of Lot 12 , Block 12 of Belleridge
Subdivision, Cape Girardeau County, Missouri, described
as follows:
All of a 10 foot strip lying West of and adjacent to the
East line of Lot 12 , Block 12 of Belleridge Subdivision,
subject to easements and rights-of-way.
ARTICLE 2 . The City of Cape Girardeau, Missouri, hereby
accepts a Temporary Construction Easement executed by Judith
Oliver, widow of Gary J. Oliver, deceased who died April 3 , 1988 ,
conveying to the City of Cape Girardeau, Missouri, a Temporary
Construction Easement for the Lexington Avenue Extension Project,
more particularly described as follows, to-wit:
All of that part of Lot 1 of Greenwood First Subdivision,
Cape Girardeau County, Missouri, described as follows:
Al1 of a 30 foot strip lying South of and adjacent to the
North line of Lot 1 of Greenwood First Subdivision, and
all of a 30 foot strip lying East of and adjacent to the
West line of Lot 1 of Greenwood First Subdivision,
containing a total of 5, 958 . 8 square feet, subject to
easements and rights-of-way.
ARTICLE 3 . The City of Cape Girardeau, Missouri , hereby
accepts a Temporary Construction Easement executed by Frank D. Bean
and Mary Ellen Bean, husband and wife, conveying to the City of
Cape Girardeau, Missouri, a Temporary Construction Easement for the
Lexington Avenue Extension Project, more particularly described as
follows, to-wit:
All of that part of Lot 76 of Greenwood Second
Subdivision, Cape Girardeau County, Missouri, described
as follows:

All of a 10 foot strip lying South of and adjacent to the
North line of Lot 76 of Greenwood Second Subdivision,
subject to easements and rights-of-way.
ARTICLE 4 . The City of Cape Girardeau, Missouri, hereby
accepts a Temporary Construction Easement executed by Shirley
Statler Grojean and David Grojean, her husband, and Cathy Statler,
a single person, conveying to the City of Cape Girardeau, Missouri,
a Temporary Construction Easement for the Lexington Avenue
Extension Project, more particularly described as follows, to-wit:
All of that part of Lot 39 of Greenwood First
Subdivision, Cape Girardeau County, Missouri, described
as follows:
All of a 10 foot strip lying South of and adjacent to the
North line of Lot 39 of Greenwood First Subdivision,
subject to easements and rights-of-way.
ARTICLE 5. This ordinance shall be in full force and effect
ten days after its passage and approval.
