AN ORDINANCE CALLING A SPECIAL ELECTION IN THE
CITY OF CAPE GIRARDEAU, MISSOURI, ON THE
QUESTION WHETHER TO GRANT THE RIGHT,
PERMISSION AND AUTHORITY TO UNION ELECTRIC
COMPANY, FOR THE PERIOD OF TWENTY YEAR3, TO
CONSTRUCT, MAINTAIN AND OPERATE WITHIN THE
CITY OF CAPE GIRARDEAU, MISSOURI, A SYSTEM FOR
THE MANUFACTURE, TRANSMISSION AND SALE OF
ELECTRICITY; DESIGNATING THE TIME OF HOLDING
SAID ELECTION; AND AUTHORIZING AND DIRECTING
THE CITY CLERR TO GIVE NOTICE OF SAID
ELECTION; AND DECLARING AN EMERGENCY TO EXIST
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
ARTICLE 1. In accordance with Section 3 . 15 of the City
Charter of Cape Girardeau, Missouri, this ordinance is declared to
be an emergency measure for the purpose of calling an election on
the question whether to enter into a franchise agreement with Union
Electric Company for an electric system.
ARTICLE 2 . A special election is hereby ordered to be held in
the City of Cape Girardeau, Missouri, on Tuesday, November 5, 1991,
on the following question:
QUESTION
Shall the City of Cape Girardeau, Missouri,
grant the right, permission and authority to
Union Electric Company, for the period of
twenty (20) years, to construct, maintain and
operate within the City of Cape Girardeau,
Missouri, a system for the manufacture,
transmission and sale of electricity?
ARTICLE 3 . The form of the notice of election for the special
election, a copy of which is hereby attached and made a part
hereof, is hereby approved.
ARTICLE 4 . The City Clerk is hereby authorized and directed
to notify the County Clerk of Cape Girardeau County, Missouri, of
the adoption of this ordinance no later than 5 : 00 o'clock P.M. on
September 10, 1991, and to include in said notification all of the
terms and provisions required by the Comprehensive Election Act,
Chapter 115 of the Revised Statutes of Missouri, as amended.
ARTICLE 5. This ordinance shall be in full force and effect
from and after its passage and approval.

NOTICE OF ELECTION
CITY OF CAPE GIRARDEAU, MISSOURI
Notice is hereby given to the qualified voters of the City of
Cape Girardeau, Missouri, that the City Council of the City has
called a special election to be held in the City on Tuesday,
November 5, 1991, commencing at 6: 00 o'clock A.M. and closing at
7 : 00 o'clock P.M. on the question contained in the following sample
ballot:
