BILL NO. 91-176 ORDINANCE NO. ����
AN ORDINANCE AUTHORIZING THE MAYOR TO EXECUTE A
SPECIAL WARRANTY DEED AND A QUIT CLAIM DEED
CONVEYING LAND TO RALPH EDWARDS SPORTSWEAR, INC. FOR
PUBLIC WORKS LAND TRANSFERS
ARTICLE l. The Mayor of the City of Cape Girardeau, Missouri,
is hereby authorized to execute a Special Warranty Deed conveying
to Ralph Edwards Sportswear, Inc. , a Missouri Corporation, a
Special Warranty Deed for public works land transfers, excepting an
easement for storm water drainage which the City will retain, more
particularly described as follows, to-wit:
Part of Lot 8 of Nothdurft's Partition of Outlot 81 in
U. S. Survey 2199, in Township 31 North, Range 13 East of
the Fifth Principal Meridian in the City of Cape
Girardeau, Missouri, more particularly described as
follows:
Commencing at an iron pin marking the West corner of Lots
5 and 6 of R.L. Sturdivant's Subdivision in the City of
Cape Girardeau, Missouri; thence South 7° 27 ' 40" West,
along the dividing line between Nothdurft's Partition and
R. L. Sturdivant's Subdivision, 361. 22 feet to an iron
pin; thence North 81° 45' 29" West, 171. 62 feet to an
iron pin marking the place of beginning; thence North 81°
45' 29" West, 148 . 73 feet to an iron pin in the East
right-of-way to Broadview Street;thence North 16° 42 ' 36"
East, along said East right-of-way line, 68 . 16 feet to an
iron pin; thence South 55° 50' 0" East, 154 . 21 feet to
the place of beginning. Containing 5, 013 square feet
more or less.
ARTICLE 2 . The Mayor of the City of Cape Girardeau,
Missouri, is hereby authorized to execute a Quit Claim Deed
conveying to Ralph Edwards Sportswear, Inc. , a Missouri
Corporation, a Quit Claim Deed for public works land transfers,
more particularly described as follows, to-wit:
Part of the abandoned Cape Girardeau Northern Railroad
right-of-way between Lots 8 and 9 of Nothdurft's
Partition of Outlot 81 in U. S. Survey 2199, in Township
31 North, Range 13 Est of the Fifth Principal Meridian in
the City of Cape Girardeau, Missouri, more particularly
described as follows: Commencing at an iron pin marking
the West corner of Lots 5 and 6 of R. L. Sturdivant's
Subdivision in the City of Cape Girardeau, Missouri;
thence South 7° 27' 40" West, along said dividing line
between Nothdurft's Partition and R. L. Sturdivant's
Subdivision, 361. 22 feet to an iron pin; thence North 81°

45' 29" West, 133 . 27 feet to place of beginning; thence
North 81° 45' 29" West, 38 . 35 feet to a point; thence
North 55° 50' 0" West, 154 . 21 feet to a iron pin on the
East right-of-way to Broadview Street; thence North 16°
42 ' 36" East, along said East right-of-way to Broadview
Street, 17 . 58 feet, to a point; thence South 55° 50' 0"
East, 193 . 98 feet to the place of beginning. Containing
2 , 919 square feet more or less. Except, however, Grantor
reserves and retains its permanent easement dated
November 24 , 1987 , and recorded in Book 475 at Page 871
of the land records of Cape Girardeau County, Missouri,
for stormwater drainage purposes.
ARTICLE 3 . The real estate conveyance contemplated by this
ordinance is subject to the approval of Tri-Con Industries, LTD.
ARTICLE 4 . This ordinance shall be in full force and effect
ten days after its passage and approval.
