AN ORDINANCE ACCEPTING WATER LINE EASEMENT
FROM KIDD'S OIL COMPANY, INC. AND A WATER MAIN
EASEMENT FROM THE CHARLES F. BLATTER AND JOYCE
E. BLATTNER VOLUNTARY TRUST AND JERRY E.
ERLBACHER REVOCABLE TRUST U/T/A, FOR A WATER
MAIN EXTENSION TO SERVE WILSON ROAD
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
ARTICLE 1. The City of Cape Girardeau, Missouri, hereby
accepts a Water Line Easement, executed by Kidd's Oil Company,
Inc. , conveying to the City a Water Line Easement for extension of
the water distribution system to serve Wilson Road, more
particularly described as follows:
A 10 foot utility easement situated in Out Lot No. 54 of Survey No.
2199, Township 30 North, Range 14 East in the City and County of
Cape Girardeau, Missouri, described as follows: Commence at the
Northeast corner of Fractional Section 12, Township 30 North, Range
13 East of the Fifth Principal Meridian; thence South 06° 16' O1"
West, along the East line of said Section, 810.27 feet to the South
line of said Out Lot No. 54; thence South 81° 31' 08" East, along
said South line 2429.91 feet to the place of beginning; thence
continue South 81° 31' 08" East, 10.02 feet to the West right-of-way
line of Minnesota Avenue; thence North 05° 19' 43" East, 286.11 feet
to a curve to the left, having a radius of 22.00 feet; thence along
said curve 21.87 feet (Chord Bears North 23° 08' 36" West, 20.98
feet) ; thence South 05° 19' 43" West, 304.00 feet to the place of
beginning, containing 0.069 acres.
ARTICLE 2 . The City of Cape Girardeau, Missouri, hereby
accepts a Water Main Easement, executed by Charles F. Blattner and
Joyce E. Blattner, Trustees of the Charles F. Blattner and Joyce E.
Blattner Voluntary Trust dated May 8, 1991, and Jerry E. Erlbacher
and Martha B. Erlbacher, Trustees of the Jerry E. Erlbacher
Revocable Trust U/T/A dated January 30, 1992 , conveying to the City
a Water Main Easement for extension of the water distribution
system to serve Wilson Road, more particularly described as
follows:
A ten foot water main easement situated in Out Lot No. 54 of Survey

Cape Girardeau, Missouri, described as follows: Commence at the

West, along the East line of said Section, 810.27 feet to the South
line of said Out Lot No. 54; thence South 81° 31' 08" East, along
said South line 2439.93 feet to the West right-of-way line of
Minnesota Avenue; thence North 05° 19' 43" East along said right-of-
way, 390.27 feet to the place of beginning; thence continue North
05° 19' 43" East, 542.33 feet to a curve to the left having a radius
of 22.00 feet; thence alonq said curve a distance of 21.87 feet
(Chord Bears North 23° 08' 27" West, 20.98 feet) ; thence South 05°
19' 43" West, 579.21 feet to the North right-of-way line of Wilson
Road; thence Northeasterly on a curve to the left having a radius of
22.00 feet a distance of 21.86 feet to the place of beginning,
(Chord Bears North 33° 48' 03" East, 20.98 feet) containing 0.131
acres.
ARTICLE 3 . This Ordinance shall be in full force and effect
ten days after its passage and approval.
