AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE
OF ORDINANCES OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, BY CHANGING THE ZONING OF A PORTION
OF 1724 NORTH KINGSHIGHWAY, CITY AND COUNTY OF
CAPE GIRARDEAU, MISSOURI FROM R-1 TO C-2
WHEREAS, the City Planning and Zoning Commission has
recommended that all of the property described in Article 1 of this
ordinance should be rezoned from R-1 Single-Family Dwelling
District to C-2 , General Commercial District; and
WHEREAS, Public Notice of such change was given as prescribed
in Chapter 30 of the Code of Ordinances of the City of Cape
Girardeau, Missouri, and public hearing was held on Tuesday,
September 6, 1994; and
WHEREAS, the City Council of the City of Cape Girardeau,
Missouri, has elected to rezone the property described in Article 1
from R-1, Single-Family Dwelling District to C-2 , General
Commercial District;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
CAPE GIRARDEAU, MISSOURI, AS FOLLOWS:
ARTICLE 1. Chapter 30 of the Code of Ordinances of the City
of Cape Girardeau, Missouri, is hereby amended to change the zoning
from the present R-1, Single-Family Dwelling District to C-2 ,
General Commercial District, for the following described property:
A tract in the Northeast Quarter, Section 26, Township 31
North, Range 13 East, in the City of Cape Girardeau,
Missouri, described as: Beginning at a right-of-way
monument on West right-of-way of Missouri State Route W,
that is the Northwest corner of a 10 acre tract conveyed
to Robert and Carol Ford in Book 440, Page 588 of Cape
Girardeau, City Records, and being East 1905. 22 and South
1021. 47 from Northwest corner Northeast Quarter Northwest
Quarter of said Section 26; thence Southeasterly along a
curve to the left having a radius of 1945. 08 feet, a
distance of 253 . 27 feet to an iron pipe; thence South 19°
13' 25" West, 248 . 83 , to a point on the line dividing C-2
zoning to the West and R-1 zoning to the East; thence
along said zoning line, South 55° 23 ' East, 337 . 25 feet
to a point on the North right-of-way of Lexington Avenue;
thence along said right-of-way North 39° 37' 34" East a
distance of 205 feet; thence along the right-of-way of
Missouri State Route W, North 05° 22 ' 26" West, 113 . 10
feet; thence North 30° 52' 17" West, 363 . 42 feet to the
point of beginning.

ARTICLE 2 . The City Council hereby finds and declares that
the property described in Article 1 hereof is at the present time
particularly suitable for the purposes and uses of C-2 , General
Commercial District, and that such changes authorized hereby are
reasonable and in reasonable conformity with the existing uses and
value of the immediately surrounding properties.
ARTICLE 3 . Pursuant to Section 3 . 15 of the Charter of the
City of Cape Girardeau, Missouri, this measure is adopted as an
emergency measure as it constitutes a Bill concerning the immediate
preservation of public peace, property, health, safety or morals.
Accordingly, this ordinance will take effect immediately upon its
passage and approval.
