AN ORDINANCE AMENDING CHAPTER 22 OF THE CITY
CODE RELATING TO SOLID WASTE FEES
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
ARTICLE 1. Section 22-39 (b) of the Code of Ordinances of the
City of Cape Girardeau, Missouri, now reading as follows:
(b) Haulers who dispose of less than twenty (20)
tons of solid waste per week at the city disposal
facility shall pay a rate of thirty dollars ($30. 00) per
ton. Private haulers who regularly use the disposal
facility and who regularly dispose of more than twenty
(20) tons of solid waste per week at the city disposal
facility shall have a rate established by contract based
on the operating costs. All fees to be established are
subject to imposed costs due to existing or newly
mandated state and federal regulations.

read as follows, to-wit:

fifty cents ($34 . 50) per ton. Private haulers who
regularly use the disposal facility and who regularly
dispose of more than twenty (20) tons of solid waste per
week at the city disposal facility shall have a rate
established by contract based on the operating costs. All
fees to be established are subject to imposed costs due
to existing or newly mandated state and federal
regulations.
ARTICLE 2 . Section 22-47 (a) of the Code of Ordinances of the
City of Cape Girardeau, Missouri, now reading as follows:
(a) Residential customers. The monthly solid waste
collection fee for residential customers shall be ten
dollars and fifty-four cents ($10.54) per dwelling unit.
Residential back door service may be provided on a
contract basis subject to fees based on the additional
operating costs associated with providing such service.

ARTICLE 3 . If any section, subsection, sentence, clause,
phrase or portion of this ordinance is for any reason held invalid
or unconstitutional by any court of competent jurisdiction, such
portion shall be deemed a separate, distinct and independent
provision and such holding shall not affect the validity of the
remaining portions hereof.
ARTICLE 4 . It is the intention of the governing body and it
is hereby ordained that the provisions of this ordinance shall
become and be made a part of the Code of Ordinances of the City of
Cape Girardeau, Missouri, and the sections of this Code may be
renumbered to accomplish such intention.
ARTICLE 5. Pursuant to Section 3 . 15 of the Charter of the
City of Cape Girardeau, Missouri, this measure is adopted as an
emergency measure as it constitutes a Bill concerning the immediate
preservation of public peace, property, health, safety or morals.
Accordingly, this ordinance will take effect immediately upon its
passage and approval.
