BILL NO. 94-123 ORDINANCE NO. ���-5� AN ORDINANCE AMENDING THE ZONING CODE OF THE CITY OF CAPE GIRARDEAU, MISSOURI, WITH RESPECT TO MULTIPLE DWELLING DISTRICT REGULATIONS; LOCAL COMMERCIAL DISTRICT REGULATIONS; GENERAL COMMERCIAL DISTRICT REGULATIONS; OFF-STREET PARKING AND LOADING REQUIREMENTS AND SPECIAL USE REGULATIONS BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU, MISSOURI, AS FOLLOWS: ARTICLE 1. Section 30-27 (b) of the Code of Ordinances of the City of Cape Girardeau, Missouri, entitled "Use Regulations" is hereby amended by the addition of one (1) new subsection, to be known as Subsection (16) , in words and figures, to read as follows: Sec. 30-27. "R-4" Multiple Dwelling District Regulations. (b) Use regulations. (16) Bed and breakfast inns or hostels, to include one (1) free-standing yard sign no more than twelve (12) square feet in area and displaying only the name of the facility. ARTICLE 2 . Section 30-28 (b) of the Code of Ordinances of the City of Cape Girardeau, Missouri, entitled "Use Regulations" is hereby amended by the addition of two (2) new subsections, to be known as Subsections (17) and (18) , in words and figures, to read as follows: Sec. 30-28. "C-1" Local Commercial District Regulations. (b) Use regulations. (17) Bed and breakfast inn or hostel, without special use permit. (18) Automatic and/or self-service car wash, with special use permit. ARTICLE 3 . Section 30-29 (b) of the Code of Ordinances of the City of Cape Girardeau, Missouri, entitled "Use Regulations" is hereby amended by the addition of three (3) new subsections, to be known as Subsections (20) , (21) , and (22) , in words and figures, to read as follows: . Sec. 30-29. "C-2" General Commercial District Regulations. (b) Use regulations. (20) Gasoline filling station, without special use permit and without sign restrictions imposed in the "C-1" district regulations. (21) Automatic and/or self-service car washes, without special use permit. (22) Vehicle repair and vehicle-body repair. ARTICLE 4 . Section 30-38 (b) of the Code of Ordinances of the City of Cape Girardeau, Missouri, is hereby amended by the addition of one (1) new subsection, to be known as Subsection (28) , in words and figures, to read as follows: Sec. 30-38. Off-Street Parking and Loading Requirements. (b) Off-street parking space . . . requirements: (28) Bed and breakfast inn or hostel: One (1) parking space for each regular dwelling unit plus one (1) parking space for each bedroom for rent, hire or lease. ARTICLE 5. Section 30-39 (d) (25) (b) of the Code of Ordinances of the City of Cape Girardeau, Missouri, entitled "Special Uses" is hereby amended by the addition of the words "handicapped or disabled individuals" so that Subsection (25) will now read, in words and figures, as follows, to-wit: Sec. 30-39. Special Use Regulations. (d) Special Uses. (25) (b) Only senior citizens, handicapped or disabled individuals would be permitted to rent, purchase or inhabit units allowed under this chapter. ARTICLE 6. Section 30-39 (d) of the Code of Ordinances of the City of Cape Girardeau, Missouri, entitled "Special Uses" , is hereby amended by the addition of one (1) new subsection, to be known as Subsection (33) , in words and figures, to read as follows: 2 . �, Sec. 30-39. Special Use Requlations. (d) Special Uses. (33) Mini-warehouse or self-storage units in "C-1" or C-2" districts. ARTICLE 7 . If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portions hereof. ARTICLE 8 . It is the intention of the governing body and it is hereby ordained that the provisions of this ordinance shall become and be made a part of the Code of Ordinances of the City of Cape Girardeau, Missouri, and the sections of this Code may be renumbered to accomplish such intention.
