AN ORDINANCE ESTABLISHING THE BOUNDARIES OF
LATERAL SEWER DISTRICT NO. 14-1-D-2 , A
SUBDIVISION OF TRUNK SEWER DISTRICT NO. 14-1-
D, APPROVING THE PLANS AND AUTHORIZING THE
CONSTRUCTION OF A SYSTEM OF SANITARY LATERAL
SEWERS IN LATERAL SEWER DISTRICT NO. 14-1-D-2 ,
UNDER A PRIVATE CONTRACT SUBJECT TO CERTAIN
PROVISIONS, IN THE CITY OF CAPE GIRARDEAU,
MISSOURI
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
ARTICLE l. That the boundaries of Lateral Sewer District No.
14-1-D-2 , a subdivision of Trunk Sewer District No. 14-1-D in the
City of Cape Girardeau, Missouri, shall be as follows:
That the boundaries of Lateral Sewer District No. 14-1-D-2, a
subdivision of Trunk Sewer District No. 14-1-D in the City of Cape
Girardeau, Missouri, shall be as follows:
A tract of land in the South Half of Section 23, Township 31 North,
Range 13 East of the Fifth Principle Meridian, more particularly
described as follows:
Begin at the Northwest corner of said Section 23; thence South 0° 39'
37" West along the West line of said Section, 2681.91 feet; thence
South 89° 49' 27" East, 2424.50 feet to the point of beginning;
thence South 89°49' 27" East 1500 feet; thence South 0° 53' West,
1672.34 feet to the North line of Woodland Place Subdivision Number
6; thence following the boundaries of said Subdivision North 86° 28'
49" West 276.95 feet; thence South 9° 41' 46" West, 228.02 feet;
thence South 76° 51' 43" West, 191.59 feet; thence Southeast 33° O1'
34" West, 250.22 feet; thence North 88° 50' 52" East, 135.00 feet to
the point of curvature of a curve to the left, having a radius of
22.00 feet and an included angle of 90 degrees; thence with said
curve 33.19 feet to the point of curvature of a curve to the left,
having a radius of 275.00 feet; thence with said curve 21.39 feet;
thence North 88° 50' 52" West, 50 feet; thence South 0° 53' West,
37.80 feet; thence South 19° 00' 23" West, 12.43 feet; thence South
86° 55' 32" East, 156.17 feet to the East line of Woodland Place
Subdivision Number 7; thence South 0° 53' West, 495.85 feet to the
South line of said Subdivision; thence North 89° 30' 08" West 1019.81
feet to the East Right of Way line of Missouri State Route W; thence
along said right-of-way line in a Northerly direction for 1221.92
feet; thence continue on said right-of-way line North 71° 15' 37"
East, 30.0 feet; thence continue along said right-of-way line in a
Northerly direction 942.05 feet; thence North 17° 23' 07" East,
205.9 feet; thence North 11° 38' 07" East, 305.04 feet to the point
of beginning.
ARTICLE 2 . That the plans for the construction of a system of
sanitary lateral sewers to serve Lateral Sewer District No. 14-1-D-
2 , a copy of which is on file in the office of the City Clerk, are
hereby approved and ordered filed.
ARTICLE 3 . That the owners of lands in said Lateral Sewer
District No. 14-1-D-2 are hereby granted permission to construct
said system of sanitary lateral sewers in Lateral Sewer District
No. 14-1-D-2 and to connect same to existing sewers in Trunk Sewer
District No. 14-1-D, subject to the following provisions.
1. That proper authority will be secured to proceed from the
Missouri Clean Water Commission.
2 . That all permanent easements for said sewers on private
property are made to the City of Cape Girardeau,
Missouri, prior to execution of a contract for the work
of construction of said sewers.
3 . That all City Ordinances, Standard Specifications of the
City and State laws applicable to this project will be
observed in all respects.
4 . That the quality of the work and materials be inspected
by the agents of the City engineer of the said City, and
that cost of said inspections be paid to said City
following the completion of the work.
ARTICLE 4 . That this Ordinance shall take effect and be in
full force from and after ten days following its passage and
approval.
