BILL NO. 94-45 ORDINANCE NO. IJUL
AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE
OF ORDINANCES OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, BY CHANGING THE ZONING OF 1809 NORTH
KINGSHIGHWAY, CITY AND COUNTY OF CAPE
GIRARDEAU, MISSOURI FROM C-4 TO C-2 AND R-1
WHEREAS, the City Planning and Zoning Commission has
recommended that all of the property described in Article 1 of this
ordinance should be rezoned from C-4, Planned Commercial District
to C-2, General Commercial District; and
WHEREAS, the City Planning and Zoning Commission has
recommended that all of the property described in Article 2 of this
ordinance should be rezoned from C-4, Planned Commercial District
to R-1, Single-Family Dwelling District; and
WHEREAS, Public Notice of such change was given as prescribed
in Chapter 30 of the Code of Ordinances of the City of Cape
Girardeau, Missouri, and public hearing was held on Monday, March
7, 1994; and
WHEREAS, the City Council of the City of Cape Girardeau,
Missouri, has elected to rezone the property described in Article 1
from C-4, Planned Commercial District to C-2, General Commercial
District;
WHEREAS, the City Council of the City of Cape Girardeau,
Missouri, has elected to rezone the property described in Article 2
from C-4, Planned Commercial District to R-1, Single-Family
Dwelling District;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
CAPE GIRARDEAU, MISSOURI, AS FOLLOWS:
ARTICLE 1. Chapter 30 of the Code of Ordinances of the City
of Cape Girardeau, Missouri, is hereby amended to change the zoning
from the present C-4, Planned Commercial District to C-2, General
Commercial District, for the following described property:
All that part of the Southeast Quarter of the Northwest
Quarter of Fractional Section 26, Township 31 North,
Range 13 East, described as follows:
Starting at the Southwest corner of the East Half of the
Northwest Quarter of said Fractional section 26, Township
31 North, Range 13 East, run North 1820.8 feet to the
South right-of-way line of U.S. Highway 61, to the point
of beginning; thence South 34° 11' West, 600 feet; thence
South 55° 49' East, 218.75 feet; thence North 34° 11'
East, 600 feet to the South right-of-way line of U. S.

Highway 61; thence North 55° 49' West, 218.75 feet to the
place of beginning, containing 3 . 0 acres, more or less.
ARTICLE 2 . Chapter 30 of the Code of Ordinances of the City
of Cape Girardeau, Missouri, is hereby amended to change the zoning
from the present C-4, Planned Commercial District to R-1, Single-
Family Dwelling District, for the following described property:
All that part of the Southeast Quarter of the Northwest
Quarter of Fractional Section 26, Township 31 North,
Range 13 East, described as follows:
Starting at the Southwest corner of the East Half of the
Northwest Quarter of said Fractional Section 26, Township
31 North, Range 13 East, run North 1820. 8 feet to the
South right-of-way line of U.S. Highway 61; thence South
34° il' West, 600 feet, to the point of beginning; thence
continue South 34° 11' West, 396.2 feet; thence South 55°
49' East, 218.75 feet; thence North 34° 11' East, 396.2
feet; thence North 55° 49' West, 218.75 feet, to the
place of beginning, containing 2 . 0 acres, more or less.
ARTICLE 3 . The City Council hereby finds and declares that
the property described in Article 1 hereof is at the present time
particularly suitable for the purposes and uses of C-2 , General
Commercial District, and that such changes authorized hereby are
reasonable and in reasonable conformity with the existing uses and
value of the immediately surrounding properties.
ARTICLE 4 . The City Council hereby finds and declares that
the property described in Article 2 hereof is at the present time
particularly suitable for the purposes and uses of R-1, Single-
Family Dwelling District, and that such changes authorized hereby
are reasonable and in reasonable conformity with the existing uses
and value of the immediately surrounding properties.
ARTICLE 5. This ordinance shall be in full force and effect
ten days after its passage and approval.
