AN ORDINANCE ACCEPTING PERMANENT EASEMENTS AND
TEMPORARY CONSTRUCTION EASEMENTS FROM LIPPS
TRUCKING, INC. ; AND MIDAMERICA HOTELS
CORPORATION FOR A CITY OF CAPE GIRARDEAU WATER
MAIN
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
ARTICLE 1. The City of Cape Girardeau, Missouri, hereby
accepts a Permanent Easement executed by Lipps Trucking, Inc. , a
Missouri Corporation, conveying to the City of Cape Girardeau,
Missouri, a Permanent Easement for the Cape Girardeau Municipal
Airport Fire Protection Main, more particularly described as
follows, to-wit:
All of that part of the Northeast Quarter of Section 26,
Township 30 North, Range 13 East of the Fifth Principal
Meridian, in the County of Cape Girardeau, State of
Missouri, described as follows:
Commence at a 1/2" diameter iron rod set in concrete
marking the Southwest corner of said Section 26, thence
with the South line of said section, East, 2 ,738. 07 feet,
to a point at the intersection of Little River Drainage
District Ditch No. 1 and Little River Drainage District
Ditch No. 4A, from which the Southeast corner to said
section bears East, 2 , 681. 37 feet, thence with Little
River Drainage District Ditch No. 4A, North 00° 35' 02"
West, 2 , 699 . 02 feet, to a point on the surveyed
centerline of existing Nash Road, thence North 00° 03 '
54" West, 65. 00 feet, to a point on the North line to
said Nash Road, thence South 89° 38' S0" East, 85. 00
feet, to the intersection of the North line of Nash Road,
with the East line of said Ditch No. 4A, thence North 00°
03 ' S4" West, 9. 93 feet, to the place of beginning;
thence North 89° 31' 21" East, 541. 15 feet, thence South

ARTICLE 2 . The City of Cape Girardeau, Missouri, hereby
accepts a Temporary Construction Easement executed by Lipps
Trucking, Inc. , a Missouri Corporation, conveying to the City of
Cape Girardeau, Missouri, a Temporary Construction Easement for the
Cape Girardeau Municipal Airport Fire Protection Main, more
particularly described as follows, to-wit:
All of that part of the Northeast Quarter of Section 26,

Missouri, described as follows:

25, 918 square feet, more or less, excepting 6,879 square
feet, more or less, being within the permanent easement.
ARTICLE 3 . The City of Cape Girardeau, Missouri, hereby
accepts a Permanent Easement executed by Midamerica Hotels
Corporation, a Missouri Corporation, successor to Victorian Inns,
Inc. , conveying to the City of Cape Girardeau, Missouri, a
Permanent Easement for the Cape Girardeau Municipal Airport Fire
Protection Main, more particularly described as follows, to-wit:
All of that part of the Southeast Quarter of Section 26,
Township 30 North, Range 13 East of the Fifth Principal
Meridian, in the County of Scott, State of Missouri, more
particularly described as follows:
Commence at a 1/2" diameter iron rod set in concrete
marking the Southwest corner to said Section 26, thence
East, with the South line of said Section 26, 4, 866. 47
feet, to the place of beginning; thence continue East,
14 .45 feet, to a point where the South line of said

Section 26 intersects the West right of way line of the
Cape Girardeau Airport Access Road, thence with the West
line of said road, North 46° 13' 35" West, 108 .84 feet,
thence North 44° O1' 56' West, 320. 00 feet, thence North
42° 12' 19" West, 1, 254 .74 feet, to the beginning of an
offset spiral transition, being 60 feet offset outside of
a spiral transition having a k value of 174 . 69, and a p
value of 6. 67, thence along said spiral 116. 09 feet, (the
chord across said spiral bears North 43° 33 ' 38" West,
116. 08 feet, thence South 52° 10' 52" West, 10. 04 feet,

ARTICLE 4 . The City of Cape Girardeau, Missouri, hereby
accepts a Temporary Construction Easement executed by Midamerica
Hotels Corporation, a Missouri Corporation, successor to Victorian
Inns, Inc. , conveying to the City of Cape Girardeau, Missouri, a
Temporary Construction Easement for the Cape Girardeau Municipal
Airport Fire Protection Main, more particularly described as
follows, to-wit:
All of that part of the Southeast Quarter of Section 26,
Township 30 North, Range 13 East of the Fifth Principal
Meridian, in the County of Scott, State of Missouri, more
particularly described as follows:
Commence at a 1/2" diameter rod set in concrete marking
the Southwest corner to said Section 26, thence East,
with the South line of said Section 26, 4, 833 .40 feet, to
the place of beginning; thence North 44° O1' 56" West,
396. 21 feet, thence North 42° 12' 19" West, 1, 254. 92
feet, thence North 43° 54' 49" West, 58. 25 feet, thence
North 43° 11' 44" West, 60. 43 feet, thence North 52° 10'
52" East, 20. 09 feet, thence South 43° 11' 44' East,

ARTICLE 5. This ordinance shall be in full force and effect
ten days after its passage and approval.
