BILL NO. 94-17 ORDINANCE NO. 1���
AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE
OF ORDINANCES OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, BY CHANGING THE ZONING OF PART OF
LOT 6 AND ALL OF LOT 7 AND 8, BLOCK 1 OF
TIMBERLANE SUBDIVISION, CITY AND COUNTY OF
CAPE GIRARDEAU, MISSOURI FROM R-1 TO C-1
WHEREAS, the City Planning and Zoning Commission has
recommended that all of the property described in Article 1 of this
ordinance should be rezoned from R-1 Single-Family Dwelling
District to C-1, Local Commercial District; and
WHEREAS, Public Notice of such change was given as prescribed
in Chapter 30 of the Code of Ordinances of the City of Cape
Girardeau, Missouri, and public hearing was held on Monday,
February 7, 1994 ; and
WHEREAS, the City Council of the City of Cape Girardeau,
Missouri, has elected to rezone the property described in Article 1
from R-1, Single-Family Dwelling District to C-1, Local Commercial
District;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
CAPE GIRARDEAU, MISSOURI, AS FOLLOWS:
ARTICLE 1. Chapter 30 of the Code of Ordinances of the City
of Cape Girardeau, Missouri, is hereby amended to change the zoning
from the present R-1, Single-Family Dwelling District to C-1, Local
Commercial District, for the following described property:
All of Lots Numbered Seven (7) and Eight (8) in Block
Numbered One (1) of Timberlane Subdivision in the City of
Cape Girardeau, Missouri, as shown by Plat recorded in
Plat Book 7 at Page 15, land records of Cape Girardeau
County, Missouri, And, part of Lots Numbered Six (6) in
Block Numbered One (1) of Timberlane Subdivision in the
City of Cape Girardeau, Missouri, as shown by Plat
recorded in Plat Book 7 at Page 15, land records of Cape
Girardeau County, Missouri, described as follows: Begin
at the Northeast corner of Lot 6; thence South 8° 12'
West with the East line of Lot 6, 141. 5 feet to the
Southeast corner of Lot 6; thence Westerly with the South
line of Lot 6, 100 feet to the Southwest corner of Lot 6;
thence North 8° 12' East, 160 feet, more or less, to the
North line of Lot 6; thence South 70° 40' East with the
North line of Lot 6, to the point of beginning. (As
conveyed in Book #474 , Page #686) .
ARTICLE 2 . The City Council hereby finds and declares that
the property described in Article 1 hereof is at the present time

particularly suitable for the purposes and uses of C-1, Local
Commercial District, and that such changes authorized hereby are
reasonable and in reasonable conformity with the existing uses and
value of the immediately surrounding properties.
ARTICLE 3 . This ordinance shall be in full force and effect
ten days after its passage and approval.
