AN ORDINANCE AMENDING SECTION 16-27 OF THE
CITY CODE RELATING TO MUNICIPAL COURT COSTS
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
ARTICLE 1. Section 16-27 of the Code of Ordinances of the
City of Cape Girardeau, Missouri, entitled "Same--Additional
Costs", reading as follows:
Sec. 16-27. Same--Additional costs.
(a) The official of the municipal court responsible
for collecting court costs and fines may assess as court
costs up to two additional dollars ($2 . 00) for each court
proceeding filed for violations of the ordinances of the
city; provided that no such fee shall be collected for
nonmoving traffic violations, for violations of fish and
game regulations, and in any proceedings in such court
when the proceeding or defendant has been dismissed by
the court.
(b) Such fees collected shall be transmitted monthly
to the city treasurer to be used for training law
enforcement officers.
is hereby repealed in its entirety, and a new Section 16-27
entitled "Same--Additional Costs", is hereby enacted in lieu
thereof, in words and figures, to read as follows, to-wit:
Sec. 16-27. Same--Additional costs.
(a) The official of the municipal court responsible
for collecting court costs and fines may assess as court
costs up to three additional dollars ($3 . 00) for each
court proceeding filed for violations of the ordinances
of the city; provided that no such fee shall be collected
for nonmoving traffic violations, for violations of fish
and game regulations, and in any proceedings in such
court when the proceeding or defendant has been dismissed
by the court.
(b) Two Dollars ($2 . 00) of such fees collected shall
be transmitted monthly to the city treasurer to be used
locally for training law enforcement officers. One
Dollar ($1. 00) of such fees collected shall be deposited
into the Peace Officer Standards and Training Commission
Fund, to be used statewide for training law enforcement
officers. The One Dollar ($1. 00) portion of such fees
shall be sent on or before the 15th day of each month to
the "Treasurer, State of Missouri", in care of the Budget
Director, Missouri Department of Public Safety.
ARTICLE 2 . If any section, subsection, sentence, clause,
phrase or portion of this ordinance is for any reason held invalid
or unconstitutional by any court of competent jurisdiction, such
portion shall be deemed a separate, distinct and independent
provision and such holding shall not affect the validity of the
remaining portions hereof.
ARTICLE 3 . It is the intention of the governing body and it
is hereby ordained that the provisions of this ordinance shall
become and be made a part of the Code of Ordinances of the City of
Cape Girardeau, Missouri, and the sections of this Code may be
renumbered to accomplish such intention.
ARTICLE 4. This ordinance shall be in full force and effect
ten days after its passage and approval.
