AN ORDINANCE AMENDING CHAPTER 17 OF THE CITY
CODE RELATING TO HINDERING PROSECUTION
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
ARTICLE 1. A new Section 17-195 of the Code of Ordinances of
the City of Cape Girardeau, Missouri, entitled "Hindering
Prosecution", is hereby enacted, in words and figures, to read as
follows:
Sec. 17-195. Hinderinq Prosecution.
A person commits the crime of hindering prosecution
if for the purpose of preventing the apprehension,
prosecution, conviction or punishment of another for
conduct constituting a crime or ordinance violation he:
(1) Harbors or conceals such person; or
(2) Warns such person of impending discovery or
apprehension, except this does not apply to a warning
given in connection with an effort to bring another into
compliance with the law; or
(3) Provides such person with money,
transportation, weapon, disguise or other means to aid
him in avoiding discovery or apprehension; or
(4) Prevents or obstructs, by means of force,
deception or intimidation, anyone from performing any act
that might aid in the discovery or apprehension of such
person.

ARTICLE 2 . If any section, subsection, sentence, clause,
phrase or portion of this ordinance is for any reason held invalid
or unconstitutional by any court of competent jurisdiction, such
portion shall be deemed a separate, distinct and independent
provision and such holding shall not affect the validity of the
remaining portions hereof.
ARTICLE 3 . It is the intention of the governing body and it
is hereby ordained that the provisions of this ordinance shall
become and be made a part of the Code of Ordinances of the City of
Cape Girardeau, Missouri, and the sections of this Code may be
renumbered to accomplish such intention.

ARTICLE 4 . This ordinance shall be in full force and effect
ten days after its passage and approval.
