HomeMy WebLinkAboutOrd.1779.09-18-1995 BILL NO. 95-189 ORDINANCE NO. ` AN ORDINANCE AMENDING CHAPTER 30 OF THE CITY CODE RELATING TO PARKING BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU, MISSOURI, AS FOLLOWS: ARTICLE 1. That portion of Section 30-2 of the Code of Ordinances of the City of Cape Girardeau, Missouri, reading as follows: Sec. 30-2. Definitions. Parking space means an all-weather surfaced area not in a street or alley and having an area of not less than one hundred eighty (180) square feet, exclusive of driveways, permanently reserved for the temporary storage of one (1) automobile and connected with a street or alley by an all-weather surfaced driveway which affords ingress and egress for an automobile without requiring another automobile to be moved. is hereby repealed in its entirety, and a new portion of Section 30-2 is hereby enacted in lieu thereof, in words and figures, to read as follows: Sec. 30-2. Definitions. Parking space means an all-weather surfaced area not in a street or alley and having an area of not less than one hundred sixty-two (162) square feet, and dimensions of not less than nine (9) feet in width and eighteen (18) feet in length for pull-in parking spaces, and nine (9) feet in width by twenty-six (26) feet in length for parallel parking spaces, exclusive of driveways, permanently reserved for the temporary storage of one (1) vehicle and connected with a street or alley by an all- weather surfaced driveway which affords ingress and egress for a vehicle without requiring another vehicle to be moved. ARTICLE 2. Section 30-2 of the Code of Ordinances of the City of Cape Girardeau, Missouri, is hereby amended by the enactment of one (1) new section, in words and figures, to rEad as follows: Sec. 30-2. Definitions. Use-by-Right. A use specifically listed as being allowed in a particular zoning classification. ARTICLE 3. Section 30-38 (b) of the Code of Ordinances of the City of Cape Girardeau, Missouri, reading as follows: Sec. 30-38. Off-street parkinq and loadinq requirements. (b) Off-street parking spaces shall be provided in accordance with the following requirements: is hereby repealed in its entirety, and a new Section 30-38 (b) is hereby enacted in lieu thereof, in words and figures, to read as follows: Sec. 30-38. (b) Off-street parking spaces, the minimum size of which shall be one hundred sixty-two (162) square feet, or nine (9) feet in width and eighteen (18) feet in length for pull-in spaces, and nine (9) feet in width by twenty-six (26) feet in length for parallel parking spaces, shall be provided in accordance with the following requirements: ARTICLE 4. Section 30-38 (b) of the Code of Ordinances of the City of Cape Girardeau, Missouri, is hereby amended by the enactment of one (1) new subsection, in words and figures, to read as follows: Sec. 30-38. Off-street parkinq and loadinq requirements. (b) (29) Day-care center or pre-school: One (1) space for every six (6) children, based on the center's regulated capacity, with a minimum of three (3) spaces designed for dropping off and picking up children, plus one (1) parking space for each employee at maximum staff level. The drop off/pick up spaces should be designed in such a manner so as not to cause children to cross the parking lot or lines of traffic. ARTICLE 5. Section 30-39 (d) (3) of the Code of Ordinances of the City of Cape Girardeau, Missouri, reading as follows: Sec. 30-39. 3pecial use requlations. (d) Special uses. (3) Any public building erected or used by any department of the city, county, state or federal government or school district. 2 . is hereby repealed in its entirety, and a new Section 30-39 (d) (3) is hereby enacted in lieu thereof, in words and figures, to read as follows: Sec. 30-39. Special use requlations. (d) Special uses. (3) Any general public building erected or used by any department of the city or county government, or a school district. Also, offices, warehouses, and other support buildings for local units of government and sub-state agencies, unless otherwise located within a zoning district which would allow a commercial or institutional facility of the same nature as a use-by-right. ARTICLE 6. Section 30-39 (d) of the Code of Ordinances of the City of Cape Girardeau, Missouri, is hereby amended by the enactment of two (2) new subsections, in words and figures, to read as follows: Sec. 30-39. Special use requlations. (d) Special uses. (34) Parking garages: For enclosed or semi- enclosed parking garages only, parking space dimensions less than the minimum size required in this ordinance may be approved under a special use permit. A building/parking plan and documentary justification for a requested variation from the minimum standards must be submitted with any application hereunder. (35) Assembly and manufacture from pre-fabricated parts of electronic and similar products in C- 2 districts. ARTICLE 7. zf any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portions hereof. ARTICLE 8. It is the intention of the governing body and it is hereby ordained that the provisions of this ordinance shall become and be made a part of the Code of Ordinances of the City of Cape Girardeau, Missouri, and the sections of this Code may be renumbered to accomplish such intention. 3.
