AN ORDINANCE ACCEPTING A GENERAL WARRANTY DEED
AND A TEMPORARY CONSTRUCTION EASEMENT FROM
MIDAMERICA HOTELS CORPORATION FOR THE CAPE LA
CROIX CREEK/WALKER BRANCH FLOOD CONTROL
PROJECT
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS :
ARTICLE 1 . The City of Cape Girardeau, Missouri, hereby
accepts a General Warranty Deed executed by MidAmerica Hotels
Corporation, a Missouri Corporation, conveying to the City of Cape
Girardeau, Missouri, a General Warranty Deed for the Cape La Croix
Creek/Walker Branch Flood Control Project, more particularly
described as follows, to-wit:
All of that part of the Southeast Quarter of Outlot
Number 80, of United States Private Survey Number 2199,
Township 31 North, Range 13 East of the Fifth Principal
Meridian, in the City and County of Cape Girardeau, State
of Missouri, described as follows:
Commence at the Southwest corner of the Northeast Quarter
of Outlot No. 80, thence South 83° 13 ' S9" East, 523 . 70
feet, thence South 06° 33 ' 11" East, 795 . 31 feet, to a
point on the South line of Kingsway Drive, at Missouri
State Plane Coordinate point Northing 540354 . 31, and
Easting 1096046 . 41, the place of beginning; thence along
the arc of a curve concave to the Northeast having a
radius of 464 . 56 feet, a distance of 15 .01 feet, (the
chord across said arc bears South 62° 49 ' 05" East, 15 . O1
feet) , to Missouri State Plane Coordinate point Northing
540347 . 45, and Easting 1096059 . 76, thence South 06° 22 '
22" East, 201 . 93 , to a point on the North line of
Broadway Street, at Missouri State Plane Coordinate point
Northing 540146 . 77, and Easting 1096082 . 17, thence North
09° 46 ' 41" West, 210 . 60 feet, to the place of beginning
and containing 1, 262 square feet, more or less, as shown
on the survey plat dated July, 1994, and revised April
12, 1995 , by Koehler Land Surveying.
ARTICLE 2 . The City of Cape Girardeau, Missouri, hereby
accepts a Temporary Construction Easement executed by MidAmerica
Hotels Corporation, a Missouri Corporation, conveying to the City
of Cape Girardeau, Missouri, a Temporary Construction Easement for
the Cape La Croix Creek/Walker Branch Flood Control Project, more
particularly described as follows, to-wit:
Al1 of that part of the Southeast Quarter of Outlot
Number 80, of United States Private Survey Number 2199,
Township 31 North, Range 13 East of the Fifth Principal

of beginning and containing 6 , 111 square feet, more or
less, as shown on the survey plat dated July, 1994, and
revised April 12, 1995 , by Koehler Land Surveying.
ARTICLE 3 . This ordinance shall be in full force and effect
ten days after its passage and approval .
