BILL NO. 95-79 ORDINANCE NO. �!(ill% AN ORDINANCE AUTHORIZING THE ACQUISITION OF PROPERTY FOR SANITARY SEWERS AND ASSOCIATED UTILITY WORR BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU, MISSOURI, AS FOLLOWS: ARTICLE 1. The City Staff is authorized and directed to acquire certain property for the creation and construction of various sanitary sewer improvements. The City Staff directly or through its contract agents is hereby authorized and directed to make appropriate offers of purchase to the owners of the properties, to negotiate with the owners of the property in an effort to reach agreement for the purchase of the property needed, and if the negotiations fail, then to proceed to acquire the needed properties through the exercise of the city's powers of Eminent Domain. ARTICLE 2 . The projects designated for this authorization are those funded through the sales tax election of April 1994 and are generally identified by name as follows: • Outfall Relief Sewer • West Side Relief Sewer • Henderson Trunk Sewer • North Henderson Combined Sewer Overflow • South Henderson Combined Sewer Overflow • Walnut/Henderson Combined Sewer Overflow • Sloan Creek Relief • Ramsey Branch Lift Station and Interceptors • Lift Stations l, 2, 3 , 4 • Fort D Combined Sewer Overflow • Main Combined Sewer Overflow • Sloan Creek Trunk Extension ARTICLE 3 . The Council of the City of Cape Girardeau, Missouri, hereby finds and declares that the acquisition of the above described properties is for a public use and that such acquisition is within the scope of the authority or power of the City of Cape Girardeau, Missouri, and that the acquisition of the properties is reasonable and necessary for public use in order to provide for sanitary sewage treatment needs of the community. ARTICLE 4 . The council is aware that staff has previously taken action and will, in the future, take further action to acquire the within described lands by purchase, negotiation and by the exercise of Eminent Domain procedures, and such activities of the Staff are hereby approved and affirmed, both prospectively and retrospectively.
