AN ORDINANCE AMENDING ARTICLE III OF CHAPTER 2
OF THE CODE OF ORDINANCES RELATING TO
ORGANIZATION OF CITY DEPARTMENTS
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
ARTICLE 1. Section 2-47 of the Code of Ordinances of the City
of Cape Girardeau, Missouri, entitled "Administrative Services
Department" reading as follows:
Sec. 2-47. Administrative services department.
An administrative services department is hereby
established. The administrative services department shall
administer the fiscal affairs of the city including the
collection, investment and disbursement of all city
funds, administer the personnel policies of the city and
provide legal counsel and representation in all legal
proceedings involving the city council, city manager, and
all city departments. The department shall perform such
other functions as may be prescribed by the city manager.

enacted in lieu thereof, in words and figures, reading as follows,
to-wit:

ARTICLE 2 . Section 2-50 of the Code of Ordinances of the City
of Cape Girardeau, Missouri, entitled "Public Works Department" ,
reading as follows:
Sec. 2-50. Public works department.
A public works department is hereby established. The
public works department shall have charge of the care and
maintenance of the city �i��t�;�t, streets, alleys,
sidewalks and other public ways. The public works
department shall have charge of the operation and
maintenance of the city's water system, sanitary sewer
system and the maintenance of storm sewers owned by the
city. The public works department shall have charge of
the collection and disposal of solid waste. The
department shall have charge of the maintenance and
repair of motor vehicles and equipment owned by the city.
The department shall perform such other functions as may
be prescribed by the city manager.
Under authority set forth in Section 70. 837 , RSMo, the
Cape Girardeau Public Safety Department is hereby
authorized to respond and provide assistance as requested
in any mutual aid or emergency aid request.

ARTICLE 3 . If any section, subsection, sentence, clause,
phrase or portion of this ordinance is for any reason held invalid
or unconstitutional by any court of competent jurisdiction, such
portion shall be deemed a separate, distinct and independent
provision and such holding shall not affect the validity of the
remaining portions hereof.
ARTICLE 4 . It is the intention of the governing body and it
is hereby ordained that the provisions of this ordinance shall
become and be made a part of the Code of Ordinances of the City of

Cape Girardeau, Missouri, and the sections of this Code may be
renumbered to accomplish such intention.
ARTICLE 5. This ordinance shall be in full force and effect
ten days after its passage and approval.
