AN ORDINANCE ACCEPTING A SANITARY SEWER LINE
EASEMENT AND A WATER LINE EASEMENT FROM
LEXINGTON PLACE, L.L.C, FOR IMPROVEMENTS IN
THE LEXINGTON PLACE SUBDIVISIONS
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
ARTICLE 1. The City of Cape Girardeau, Missouri, hereby
accepts a Sanitary Sewer Line Easement, executed by Lexington
Place, L.L.C. , a Missouri Limited Liability Company by G. Keith
Deimund, conveying to the City a Sanitary Sewer Line Easement, for
improvements in the Lexington Place Subdivisions, more particularly
described as follows:
All of that part of Lot Numbers 13 of Lexington Place lst
Subdivision, and all of that part of Lot No. 1 of
Lexington Place 3rd Subdivision, as recorded in the Land
Records of Cape Girardeau County, Missouri, more
particularly described as follows:
All of the Western Most 10 feet of said Lot 1 and 13 ,
being measured along the entire Frontage of said lots and
along the right of way line of North Church Street, and
being 10 feet in width as measured normal to said right
of way.
ARTICLE 2 . The City of Cape Girardeau, Missouri, hereby
accepts a Water Line Easement, executed by Lexington Place, L.L.C. ,
a Missouri Limited Liability Company by G. Keith Deimund, conveying
to the City a Water Line Easement, for improvements in the
Lexington Place Subdivisions, more particularly described as
follows:
All of that part of Lot Number 19 of Lexington Place lst
Subdivision, as Recorded in the Land Records of Cape
Girardeau County, Missouri, more particularly described
as follows:
Commence at the Southwest corner of said Lot No. 19, said
point being on the Easterly right-of-way line of
Lexington Street; thence North 72 ° 56' 44" East, 175. 69
feet, to a point on the South right-of-way line of North
Church Street, the point of beginning; thence South 89°
10' 56" West, 66. 24 feet; thence North 58° 34' 02" West,
12 . 00 feet; thence North 19° 27 ' 25" West, 47 . 56 feet, to
a point on the South right-of-way line of North Church
Street; thence with said South line, South 58° 34 ' 03"
East, 65.23 feet, to the point of curvature of a curve to
the left, said curve having a radius of 150. 00 feet;
thence along the arc of said curve, a distance of 40. 17
feet, to the place of beginning and containing 1, 674 sq.
ft. , more or less.
All of that part of Lot Numbers 11 and 12 of Lexington
Place 2nd Subdivision, as Recorded in the Land Records of
Cape Girardeau County, Missouri, more particularly
described as follows:
All of the Eastern Most 10 feet of said Lots 11 and 12,
being measured along the entire Frontage of said lots
along the right-of-way line of Paul Revere Drive, and
being 10 feet in width as measured normal to said right-
of-way.
ARTICLE 3 . This ordinance shall be in full force and effect
ten days after its passage and approval.
