AN ORDINANCE GRANTING A SPECIAL USE PERMIT TO
FIRST CHRISTIAN CHURCH (DISCIPLES OF CHRIST)
AND MEMORIAL FUNERAL CHAPEL OF CAPE GIRARDEAU,
INC. , FOR PURPOSES OF MAINTAINING AND
OPERATING A FUNERAL CHAPEL AT 829 NORTH WEST
END BOULEVARD, IN THE CITY AND COUNTY OF CAPE
GIRARDEAU, MISSOURI
WHEREAS, First Christian Church (Disciples of Christ) is the
owner of certain property in the City of Cape Girardeau, on which
Memorial Funeral Chapel of Cape Girardeau, Inc. desires to maintain
and operate a funeral chapel; and
WHEREAS, the proposed location of said funeral chapel is 829
North West End Boulevard, which property is presently zoned R-3 ,
Two-Family Dwelling District; and
WHEREAS, a Special Use Permit is required for said use in a
R-3 zone;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
CAPE GIRARDEAU, MISSOURI, AS FOLLOWS:
ARTICLE 1. The City Council having duly considered the
application finds that the granting of the Special Use Permit will
not substantially increase traffic hazards, congestion, fire
hazards or adversely affect the general character of the
neighborhood or the general welfare of the community, nor will it
overtax public utilities or be in conflict with the comprehensive
plan.
ARTICLE 2 . A Special Use Permit for purposes of maintaining
and operating a funeral chapel, on the following described
property:
All of Lots One (1) , Two (2) and Three (3) in Block Two (2) of
Monticello Addition in the City of Cape Girardeau, Missouri.
Also, an alley 15 feet in width lying West of Lots One (1) , Two (2)
and the East of Lot Three (3) in Block Two (2) of Monticello
Addition in the City of Cape Girardeau, Missouri.
Al1 of Lots Seventeen (17) and Eighteen (18) in Block Two (2) of
Monticello Addition to the City of Cape Girardeau, Missouri.
All of Lot No. Nineteen (19) in Block No. Two (2) in Monticello
Addition, in the City of Cape Girardeau, Missouri, as same is laid
down and designated on the Official Plat of said Addition of record
in the Recorder's Office at Jackson, Missouri, in Plat Book 2 at
Page 60.
An Alley fifteen (15) feet in width lying just West of Lots One (1)
and Two (2) and just East of Lot Three (3) in Block Two (2) of the
Monticello Addition to the City of Cape Girardeau, Missouri, running
South from Dunklin Street One Hundred Fifty (150) feet to an alley.
The City of Cape Girardeau retains the right to install, lay, erect,
conatruct, maintain, operate, repair and replace, by itself or by
its agents, servants and assigns or any licensee or a holder of a
franchise from the City, any poles, wires, pipes, conduits, sewer
pipes, sewer units, water mains, or any other facility or equipment
for the installation, maintenance or operation of any utility now
located or to be located in the future in the alley above described.
is hereby granted to First Christian Church (Disciples of Christ)
and Memorial Funeral Chapel of Cape Girardeau, Inc. , to be
effective ten (10) days after the date of passage and approval of
this ordinance. The special use must comply with all regulations
set forth in the Zoning Code for the district in which the use is
located except those which have been specifically excepted under
this permit, and all other applicable ordinances of the City of
Cape Girardeau and any special conditions contained in the Special
Use Permit, a copy of which is attached hereto and incorporated
herein by reference. The City Manager is hereby given the power to
execute the Special Use Permit for and on behalf of the City of
Cape Girardeau, Missouri.
ARTICLE 3 . Pursuant to Section 3 . 15 of the Charter of the
City of Cape Girardeau, Missouri, this measure is adopted as an
emergency measure as it constitutes a Bill concerning the immediate
preservation of public peace, property, health, safety or morals.
Accordingly, this ordinance will take effect immediately upon its
passage and approval.

This Special Use Permit is granted upon the condition that the
Applicant be bound by all City Ordinances which pertain to the
Special Use Permit and that the Applicant be bound by the following
conditions which are imposed as a condition of issuance of this
Special Use Permit. Upon the failure of the Applicant to comply
with these special conditions, the Special Use Permit will
automatically terminate and the City of Cape Girardeau shall have
the right to enter upon the land to abate such special use.
SPECIAL CONDITIONS:
1. Additions or modifications from the original building
permit must be approved by the City Council.
2 . Special use shall meet all applicable zoning regulations.
3 . This Special Use Permit shall automatically terminate in
six (6) months upon the failure to develop the use of the
land for which the Special Use Permit has been issued.
4. This Special Use Permit is not transferrable without
consent of the City Council.

The Cape Girardeau City Council convened in regular session on Monday,June 15, 2009, at 7:00
p.m.,with Mayor Jay B. Knudtson presiding and Council MembersCharlie Herbst, Mark Lanzotti,

Prior to the regular session,the City Council convened in closed session for purposes of discussing
litigation, personnel and confidential communications with the City Attorney pursuant to RSMo.

The minutes of the May 28, 2009, closed session, and June l, 2009, regular and closed sessions

COUNCIL COMMUNICATIONS
Mrs. Tracy said that she had attended the celebration at the Rose Garden, and she expressed
appreciation far those who maintain it.
Mayor Knudtson stated that he had attended the golf course improvements groundbreaking at the
Jaycee Municipal Golf Course, and he commended the City's Parks and Recreation staff on their
efforts.
Mrs. Heather Brooks, Assistant to City Manager, introduced Mrs. Barbara Machi who is
completing a Masters Degree in Public Administration at Southeast Missouri State University and
will be int�-ning in the City Manager's office.
PUBLIC HEARINGS
This being the date set for a public hearing regarding the request of Mr. and Mrs. Ken and Carol
Oberlohr to rezone the property located at 2254 Kingsway Drive from R-1, Single-Family
Residential District, to G2, General Commercial District, the hearing was opened. Mr. Oberlohr
appeared in support of the rezoning request, and to answer questions. There being no further
appearances,the hearing was closed.

This being the date set for a public hearing regarding the Request of Wireless Asset Group, LLC, �
for a Special Use Permit to construct a 180-foot monopole telecommunication tower and fenced I
compound on the property at 813 Southern Expressway, the hearing was opened by Mayor
Knudtson. The City Planner's Council Letter in the agenda packet presented for the record a
certified copy of the following items: (1) Section 30-39 entitled "Special Use Regulations"from
the City Code; (2) the application for special use permit; and (3) the application file. Ms. Nancy
Browne,an attorney for Wireless Asset Group, LLC, appeared before the Council in support of the
request, and to answer questions There being no further appearances,the hearing was closed.

Mr. Bryan Crain of Crain Funeral Home appeared before the Council in support of the motion to

The transfer of ownership of a Special Use Permit from William and Beriy Kuss of the First
Christian Church (Disciples of Christ) and Memorial Funeral Chapel of Cape Girardeau, Inc. to
Bryan A. Crain, Crain Funeral Home, for a funeral chapel at 829 North West End Boulevard, was
approved upon Mrs. Schneider's motion, Mrs. Tracy's second, and the following vote: Ayes,

Mr. Felix Kinsley,of 325 North Sprigg, appeared before the Council to commend the City of Cape
Girardeau bus system and to support the City's contract with Cape Girardeau County Transit
Autharity to manage it.
Ms. Coby Cuzzocrea of 1105 Linden appeared to express her concern that Cape Girardeau Police
officers are abusing their powers. She asserted that an officer had stopped her and her nephew as
she was traveling on the street in her powered mobility chair, due to his alleged concern about her
nephew's behavior. Ms. Cuzzocrea said that the officer then followed her to her home, and later,
the Department of Family Services was contacted by the Police Department to investigate her
nephew's care. She stated that she was very upset and wanted that police officer to apologize for
his behavior. She said that she was also concerned that the electronic pedestrian crossings do not
allow enough time for ped�trians to cross the streets.
Mayor Knudtson responded that City staff will look into the stop light pedestrian crossing issue
she addressed, and Police Chief Kinnison will check into her concerns about the police officer.

Ms. Ritter asked for an explanation of Article 2 regarding the debt service on the sewer SRF State
Revolving Fund bonds. Mr. John Richbourg, Finance Director, explained that SRF State
Revolving Funds offer a subsidy on interest. The deferred interest is then used instead of the State
interest subsidy to pay the bonds. The unused interest subsidy will be used later to make future
payments.
