AN ORDINANCE ACCEPTING A GENERAL WARRANTY DEED
AND A TEMPORARY CONSTRUCTION EASEMENT FROM
KATHERINE L. DARBY FOR THE CAPE LA CROIX
CREEK/WALKER BRANCH FLOOD CONTROL PROJECT
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI , AS FOLLOWS :
ARTICLE l . The City of Cape Girardeau, Missouri, hereby
accepts a General Warranty Deed executed by Katherine L. Darby, a
single person, conveying to the City of Cape Girardeau, Missouri,
a General Warranty Deed for the Cape La Croix Creek/Walker Branch
Flood Control Project, more particularly described as follows, to-
wit:
That part of Lot Numbered 3, of Block Numbered 1, of
Landgraf 's Third Subdivision, as shown by plat recorded
in Plat Book 6 , at page 19 in the Land Records of Cape
Girardeau County, and being a part of Outlot Number 75,
of United States Private Survey Number 2199, in Township
31 North, Range 13 East of the Fifth Principal Meridian,
in the City and County of Cape Girardeau, State of
Missouri, described as follows:
Begin at a point in Walker Creek, being on the Northeast
Corner of said Lot Number 3, thence wlth the North line
of said Lot, North 73° 38 ' 02" West, 39 . 95 feet to
Missouri East Zone State Plane Coordinate Northing
542, 588 . 19 , and Easting 1, 096, 874 . 28 , thence South 15°
34 ' 03" West, 58 . 64 feet, to Missouri East Zone State
Plane Coordinate Northing 542, 531. 70 , and Easting
1, 096 , 858 . 55 , thence South 13° 28 ' 19" West, 22 . 48 feet,
to Missouri East Zone State Plane Coordinate Northing
542 , 509 . 83, and Easting 1, 096 , 853 . 31, thence South 63°
O1 ' 55" East, 43 . 90 feet, to the Southeast Corner of said
Lot Number 3, thence with the East line of said Lot,
North 13° 03 ' 37" East, 89 . 32 feet, to the place of
beginning and containing 3 , 547 square feet, more or less.
ARTICLE 2 . The City of Cape Girardeau, Missouri, hereby
accepts a Temporary Construction Easement executed by Katherine L.
Darby, a single person, conveying to the City of Cape Girardeau,
Missouri, a Temporary Construction Easement for the Cape La Croix
Creek/Walker Branch Flood Control Project, more particularly
described as follows, to-wit:
That part of Lot Numbered 3, of Block Numbered 1, of

ARTICLE 3 . This ordinance shall be in full force and effect
ten days after its passage and approval .
