AN ORDINANCE AMENDING CHAPTER 26 OF THE CITY
CODE RELATING TO MOTOR VEHICLE INSURANCE
REQUIREMENTS
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
ARTICLE 1 . Chapter 26 of the Code of Ordinances of the City
of Cape Girardeau, Missouri, is hereby amended by the enactment of
a new Section 26-354 entitled "Motor Vehicle Financial
Responsibility Requirements" , in words and figures, to read as
follows:
Sec. 26-354. Motor Vehicle Financial Responsibility
Required.
(a) No owner of a motor vehicle registered in this
state, or required to be registered in this state,
shall operate the vehicle, or authorize any other
person to operate the vehicle, unless the owner
maintains financial responsibility for said motor
vehicle in a manner provided for in Section
303 . 160, RSMo. , as amended.
(b) No person shall operate a motor vehicle owned by
another with the knowledge that the owner has not
maintained financial responsibility unless such
person has proof of financial responsibility which
covers the person's operation of the other's motor
vehicle.
ARTICLE 2. Chapter 26 of the Code of Ordinances of the City
of Cape Girardeau, Missouri, is hereby amended by the enactment of
a new Section 26-355 entitled "Insurance Identification Cards
Required" , in words and figures, to read as follows:
Sec. 26-355. Insurance Identification Cards Required.
(a) An insurance identification card shall be carried
or maintained in every insured motor vehicle at all
times by the motor vehicle owner.
(b) The operator of an insured motor vehicle shall
exhibit the insurance identification card insuring
said motor vehicle or said operator on demand of
any peace officer who lawfully stops such operator
or investigates an accident while that officer is
engaged in the performance of the officer's duties.

(c) No person shall be found guilty of violating this
section if it is demonstrated to the court that
said person met the financial responsibility
requirements of this section at the time the peace
officer wrote the citation.
(d) The following shall suffice as proof of insurance
in place of provision of an insurance
identification card: A motor vehicle liability
insurance policy, a motor vehicle liability
insurance binder, or a receipt for insurance which
contains the policy information: name and address
of insurer, name of named insured, policy number,
effective date of policy, and a description of the
insured motor vehicle, including the VIN number or
the word "Fleet" if the policy covers five (5) or
more vehicles.
ARTICLE 3. If any section, subsection, sentence, clause,
phrase or portion of this ordinance is for any reason held invalid
or unconstitutional by any court of competent jurisdiction, such
portion shall be deemed a separate, distinct and independent
provision and such holding shall not affect the validity of the
remaining portions hereof.
ARTICLE 4. It is the intention of the governing body and it
is hereby ordained that the provisions of this ordinance shall
become and be made a part of the Code of Ordinances of the City of
Cape Girardeau, Missouri, and the sections of this Code may be
renumbered to accomplish such intention.
ARTICLE 5. This ordinance shall be in full force and effect
ten days after its passage and approval.
