BILL NO. 97-104 ORDINANCE NO. ���;-�
AN ORDINANCE VACATING THE CITY'S INTEREST IN
AN EASEMENT FOR SANITARY SEWERS IN COLLEGE
PARK ADDITION, IN THE CITY OF CAPE
GIRARDEAU, MISSOURI
WHEREAS, the City Council has received a request that the City
vacate an easement for sanitary sewer purposes in College Park
Addition, and more particularly described in Section 1 hereof; and
WHEREAS, the City Council set the date of June 2 , 1997 , for a
public hearing on this request; and
WHEREAS, at least ten (10) days notice of the time and place
of this hearing was published in a newspaper of general circulation
in the City; and
WHEREAS, a public hearing was held on June 2 , 1997 , at which
all interested parties were afforded the opportunity to speak in
favor of or in opposition to the proposed easement vacation; and
WHEREAS, the City Council has determined that the easement in
question is not necessary or needed for the purposes for which it
was dedicated and established; and
WHEREAS, it is in the public interest that the easement be
vacated;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
CAPE GIRARDEAU, MISSOURI , AS FOLLOWS:
ARTICLE l . The City' s interest in an easement on the
following described real estate:
Lots 23 and 24 , Block 2 , College Park Addition, City of
Cape Girardeau, Missouri.
is hereby vacated.
ARTICLE 2 . This ordinance shall be in full force and effect
ten days after its passage and approval .

Missouri, a Municipal Corporation of the State of Missouri , and
that the seal affixed to the foregoing instrument is the seal of
said City and that the said instrument was signed and sealed in
behalf of said City by authority of its City Council and
acknowledged said instrument to be the free act and deed of said
City.
