AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE
OF ORDINANCES OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, BY CHANGING THE ZONING OF A TRACT IN
THE 2500 BLOCK OF BOUTIN DRIVE, CITY AND
COUNTY OF CAPE GIRARDEAU, MISSOURI FROM R-1 TO
C-3
WHEREAS, the City Planning and Zoning Commission has
recommended that all of the property described in Article 1 of this
ordinance should be rezoned from R-1 Single-Family Dwelling
District to C-3 , Central Business District; and
WHEREAS, Public Notice of such change was given as prescribed
in Chapter 30 of the Code of Ordinances of the City of Cape
GirardeaU, Missouri, and public hearing was held on Monday, June 5,
1997 ; and
WHEREAS, the City Council of the City of Cape Girardeau,
Missouri, has elected to rezone the property described in Article 1
from R-1, Single-Family Dwelling District to C-3 , Central Business
District;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
CAPE GIRARDEAU, MISSOURI, AS FOLLOWS:
ARTICLE 1. Chapter 30 of the Code of Ordinances of the City
of Cape Girardeau, Missouri, is hereby amended to change the zoning
from the present R-1, Single-Family Dwelling District to C-3 ,
Central Business District, for the following described property:
That part of the North Half of Section 23 , Township 31
North, Range 13 East of the Fifth Principal Meridian,
described as follows:
Commence at the Southeast corner of the Northwest Quarter
of said Section 23 ; thence South 88° 16' 41" West, along
the Quarter Section line, 231. 00 feet to the place of
beginning; thence continue South 88° 16' 41" West, 278 . 00
feet to the center of the West Branch of Cape LaCroix
Creek; thence along said Creek with the following
courses; North 18° 00' 00" West, 215 . 00 feet; North 24 °
00� 00" West� 232 . 50 feet; NOY'th 07° 30� 00" West� 190 . 00
feet; North 30° 00' 00" East, 230. 00 feet; thence North
09° 06' 09" West, 324 . 17 feet to the South Right-of-way

along said right-of-way, 117 .96 feet; thence North 48°

132 . 34 feet; thence departing from said right-of-way,

in the City and County of Cape Girardeau, Missouri.
Subject to existing easements.
ARTICLE 2 . The City Council hereby finds and declares that
the property described in Article 1 hereof is at the present time
particularly suitable for the purposes and uses of C-3 , Central
Business District, and that such changes authorized hereby are
reasonable and in reasonable conformity with the existing uses and
value of the immediately surrounding properties.
ARTICLE 3 . This ordinance shall be in full force and effect
ten days after its passage and approval.
