Houck's Missouri & Arkansas Railroad Company accent the terms and
provisions of Ordinance ?To. 620, entitled "An Ordinance granting to Houck's
Missouri & Arkansas Railroad Company a franchise over and along Fountain,
Merriwether and 'Tidcile streets to Independence and Frederick streets, in
the City of Cape Girardeau' Missouri, subject to certain conditions", ap-
proved December 26, 1900, and agrees to carry the same in frill effect; but
it is to be understood that the Company reserves the right to ask from
the Honorable Ya.yor and City Council certain modifications of said Ordi-
nance, especial_ -y a change of said Ordinance permitting the use of a par-
apeted opening along Fountain street from the Oak's lot to Morgan Oak
street, and between Morgan Oak and Good Hope streets, instead of the
board covering.

across and the same covered by two thicknesses of 2" Plank, laid diagon-
ally, as 'before provided, at the option of the City Council. -About Station
53 x 60 to 54 X 60 there shall. be a trestle 100 ft. long, built on piles
or framed bents- If of miles, then 4 piles to the bent, of not less than
10 inches iA the small end driven batteF If framed, then heavy mud
sills scored on two sides, 2 savied posts and two sawed batte rposts 12 x
12, Caps in either case 12 X 12 in 1.2 ft , and two ply stringers, 8 x
14 inches- Sacred ties laid 18 inches from C to C, with 6 x 8 guard rails .
At small. drain on Yiddle Street, an opening of Sewer pipe 36 inches
diameter, or 4 feet stone culvert to be put in. ,Ihenever Merriwether and
Williams street shall. be improved and graded ytp to the embanicnent of the
Railroad, said Railroad Company shall make suitable crossing by planking
its tracks to the crown or the rail -s.
In the prosecution of the work of grading, whenever there shall be
waste earth, after making necessary fills in the road bed, the same
shall be placed,under the direction of the City Boss, on such intersect-
ing streets as are required to be raised.
.And in general, the construction of said road along the located line
shown on the map hereto attached, is in all. things to conform to the re-
quirft*nts of said Ordinance, No. 620, and the grade line to be
'he Erade 'ine represented on the profile hereto attached.
