An Ordinance Erantin,the Southern AT61ePhOne Company of Illinois,the right
to establish an _o,'N'ice in the Citi of _Cape (jirardeau, for telephone purposes,
and srantin� right to use thestreets ofthe city for erection of poles
and wires for the purpose.
He ,, L ordained b� the Uouncil of the City of Cape Girardeau, Missouri, as
follows:
Sec. 1. - That t'he,- ri-,,ht aLid aWhority be and is hereby given and orantleldk
unto the Southern Union Telephone Uompan a corporation duly or-
ganized under the laws of the State of Illinols,iLs successors
and assi6ns,to erect and maintain or, the s1lreets,the poles,wires
and fixtures necessary and convenient for opening and maintainir,;:;
an office within said city for conducting, its business and fur-
nishing to the public communication by means of long distance tel6-
pnone- and other improved electrical device,subject to the follow -
in, conditions,nameiy:

iets,wherever practicable, cable, and. when so placed in alleys, be

able,and the same bhall be so maintained at all times whereN"er sit-

in.; properiLy, owners. All poles erected in the stureets,alleys and
avenues of the city shall be under the supervision and direction
of the Str:-et and Wharf Committee ofl the Uiluly Council,and shall be
placed immediately within the curb line and at t -.he -,;'in-- dividirI6

street corners, and in all cases such poles -hall be placed as not
to interfere with the drainage and sewers anal water pipes.

be not less than four inches in diameter at the smaller end and

shall be well placed in the ground,at least four feet and well and secure-
ly tamped therein, and when s.q erected shall be, at their upper end
at least twenty five feet above the surface of the ground.
5e_c.-'- ._- When sidewalks or pavements payees removed by the grantees for the
purpose of erectin,5 telephone-A,the same shall within ten da;s be
replaced by them attheir own expense and put in as rood .condition
as they were before such removal, and it said grantees fail tc per-
forri said work within ten days, there the Street Commissionersh all at
once do said work aL the cost of said orantees;and nothing in this
ordinance shall be so construed as to exempt said grantees from
complying with thte re-ula.tions now or hereafter ordained by said
City Council in regard to makinz, excavations in or upon its streets,

Sec.4.- All telephone wires shall be of sufficient and ordinary strength.
for such purposes and shall be well stretched and securely fasten-
ed to said poles,or to the cross connections therewith,and aL the
point where. fastened to said poles,or cross connecti.ons,sha.il be at
least twenty five feed, above the surface of tile ground.
The fates charged for telephone communication passim; over the toll
lines eT'ected hiereunder,sha.il not exceed the rates established or
which may from time to time b� prescrit ed by the American 'Telephone
and 'Tale6raph Company for similar service.
Seca?.. T,e ri.6ht hereby ?ranted shall be for a period. of twenty (`,0) years
from and a.iter the passage of this ordinance. The City Council ex-
pressly reserves the ri6ht to -rant a similar franchise,upon proper
appli--atloI7, ther•c3f or, Lo any persons or corporation, such errant how -
eve[. not to be destructive to the rl�; ht herein given and granted..
Sec.7.- This ordinance shall be absolutely null and void unless an office
be first established iri this city for the purpose of transacting
business and before any business shall be done,and the certificate

ion 'Telephone Company,..to do business in this utate,be filed with the

Sec. 8.- In consideration of this franchise bein-, branted by the cit it

Southern Union Telephone Company shall wilib in twenty (20) days
after its approval by the Mayor,fiJ_e with the City Clerk,its ac-
ceptance of the terms of this ordinance and agree to carry it in-
to full effect;ana on such acceptance and a6reement beim filed,
snail be in full force aria effect.
Sec. 11.- This ordinance shall Lake effect and be in force from and after
its passage.
