AN ORDINANCE PROVIDING FOR THE CONSTRUCTION OF NORkAL
AVENUE FROM THE WEST GUTTER LINE OF PACIFIC STREET TO THE EAST
GUTTER LINE OF HENDERSON AVENUE, IN THE CITY OF CAPE GIRARD+'AU,
MISSOURI.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
SECTION 1: That the Council of the City of Cape Girardeau,
Missouri, by a resolution in writing, duly adopted at a regular
meeting thereof, on the 5th day of November, 1917,found and
declared it necessary to improve that part of Normal Avenue from
the West gutter line of Pacific Street to the East gutter line of
Henderson Avenue, in the City of Cape Girardeau, Missouri, being a
distance of approximately 1078 feet, along which the property feet
subject to assessment totals approximately 2084 feet. The width of
said Normal Avenue between property lines is 155 feet. There are
two driveways to be paved, a north and south drivewag, each drive-
way to be 24 feet wide. Said improvement to be done by grading
each driveway of said street, and also the whole portion of said
street directly in front of the main entrance of the main building
of the State Normal School, at which place the width is 155 feet,
to the established grade, installing the necessary drain -pipe and
constructing a concrete pavement; thereon, the pavement on the
driveways to be 24 feet wide and 6 inches in thickness, the mixture
of concrete to be two parts of cement to three parts of sand and
six parts of crushed rock and gravel. The full width of the street,
127 feet., tQ be thus paved in that portion directly in front of
the kx t xg main building of the State Normal School. That said
work of improvement be done in accordance with the profile,
plans and specifications and estimate of the costs for said im-
provement of said part of Normal Avenue, prepared by the City
Engineer, under instructions of the Street and Wharf Committee,
and adopted and approved by the City Council on the lst day of October,
1917, and ordered filed in the office of the city clerk; and also
said improvement to be done in aceo,rdance with Ordinance No. 1157,
a general ordinance concerning streets, approved 9� 20th, 1917,
the council deeming it necessary and as a single improvement.
SECTION 2: That the council finds and declares that said
resolu io—n as een published for seven consecutive issues in the
Daily Tribune and two consecutive issues in the Weekly Tribune,
newspapers published in the City of Cape Girardeau, Missouri, and
doing the printing for said city, and that no sufficient protest
has been filed with the City Clerk, or submitted to the Council,
against the improvement to be made.
SECTION 3; That the council having complied with all re-
quirements imposed by law and ordinance, and thus having acquired
authority so to do, it is hereby ordered and directed that Normal
Avenue from the west gutter line of Pacific Street to the East
gutter line of Henderson Avenue, in said city, be improved by grading
and paving two drive -ways, each 24 feet wide, said pavement to
be 6 inches in thickness, and installing necessary drain pipe; and
grading, paving with concrete 6 inches in thickness and installing
the necessary drain pipe, the full width of said Normal Avenue,
155 feet, immediately in front of the main entrance of the main
building of the State Normal School.
SECTION 4: That said work on said part of Normal Avenue
shall be cone by contract, and shall in all respects comply with
the estimates, plans and specifications therefor, approved by the
Council on the first Ray of October, 1917, on file in the office
of the City Clerk; and Ordinance No. 1157, approved August 20th,
1917, and this ordinance; and no contract for said improvement shall
be made and entered into in excess of the estimate of the cost of
the whole work made by the City Engineer, and on file in the office
of the City Clerk as aforesaid.
SECTION 5: That when said work of improvement of Normal
Avenue as een completed according to the plans, specifications,
and the contract therefor, and aeeepted by the City Engineer and
the Street & Wharf Committee, and their several reports thereon ap-
proved by the Council, then the City Clerk is ordered and instructed
to issue special tax bills in favor of the contractor and against the
lits and tracts of land abutting on the said part of Normal Avenue,
along the whole distance improved, in proportion to the number of
abutting or front feet, in accordance with said Ordinance No. 1157,
in payment for said improvement.
SECTION 6: That the City Clerk is hereby authorized and
instructed to advertise for bids in the newspaper doing the city
printing, for the construction of said improvement, according to
the estimate, plans and specifications, and in accordance with
Ordinance No. 1157 aforesaid, and advising bidders of the deposit
and bond to be given, and that the contract will not be awarded the
successful bidder unless he stipulates in his proposal that he
will accept special tax bills to be issued against the abutting
property in payment for the work; and he will in no event hold the
city liable for the cost of the work, or any part thereof, and will
on completion of the work, pay the costs of the engineer's ser-
vices, or any other costs accruing in fulfilling his contract..
SECTION 7: This ordinance shall take effect and be in
force from an after its passage.
