WHEREAS, The Council of the City of Cape Girardeau, 1,1issouri, on the 20th day of August, 1924, adopted a resolution declaring it necessary to im- prove that part of Henderson Avenue from the pavement at the intersection of Broadway and Henderson to the pavement at the intersection of Harmony and Henderson, by graving to the established grade, and constructing thereon con- crete curbs and gutters and e sil inch (611) concrete pavement 36 feet in width, and, WHE'Ft,AS, The Council of ti,.e City o; Cape Girardeau, Missouri, thereafter and on the 22nd day of September, 1924, passed an ordinance declaring it nec- essary to improve that part of Henderson Avenue from the pavement at the in- tersection of Broad-uay and Henderson Avenue to the pavement at the intersec- tion of Harmony and Henderson, by establishing the grade, grading to the es- tablished grade, and constructing thereon concrete curbs and gutters and a six inch (611) concrete pavement 36 feet in width and ordering the City Clerk to advertise for bids for doing said .improvement and further ordering that said improvement be made, said. ordinance being Commission Form Ordinance No. 289, and, 4IIHEFEAS, By virtue of authority created by said ordinance, the City Clerk of said city advertised for bads for the doing of said work- by publishing an advertisement therefor in the Cape Girardeau Southeast Missourian, a daily newspaper published in the City of Cape Girardeau and doing the city print- ing, as required by ordinance, and, IIHEIIEAS, F. ;gid. Keller, contractor, was awarded the contract to make the said improvement according to the plans and specifications therefor made by the City Engineer and for the price and sum set forth in said contractor's proposal, and the said contractor agreed to accept as payment for said im- provement special tax bills to be issued by the City Clerk of the city of Cape Girardeau, there being insufficient funds in the General Revenue Funds of said city to pay therefor, in his favor as contractor, against the abutting property on that part of said street hereinbefore described, upon the comple- tion by said contractor of said improvement, as provided for in Commission Form Ordinance No. 50 and CorLmission Form Ordinance No. 289 of said city, it having been the opinion of the City Council of said city before said contract was awarded that the bid of the said 1'. W. Beller for doing the sai6 improve- ment bras the lowest and best bid thereon and said contract was awarded only after a motion was made, secorfded and duly sassed by the said Counc -1, ac- cepting the said bid, and, WHEREAS The said F . Heller entered into a contract with the said city on the q 4 day ofA _ , 1924, for the doing of said work and exe- cuted a bond for the faithful performance thereof and for the making of said improvement according to said Commission Form Ordinance No. 289 and said Com- mission Form Ordinance No. 50, and, `SHEREAS, The said work of improving that part of Henderson Avenue from the pavement at the intersection of Broadway and Henderson to the pavement at the intersection of Harmony &: Henderson, has been completed according to the plans and specifications therefor and according to said. ordinances and said work has been accepted by the City Council of the City of Cape Girardeau, Miss- ouri, and the City Engineer of said city has filed his report of the cost of said improvement on its completion, said report showing the total price of said improvement to be $5533.36. NOW TH:CREFORY, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CA13E GIR- ARI7EAU, MISSOURI, AS FOLLOWS : - . 1 . SECTION 1. That for the purpose of paying the said. F. U. Heller, con- tractor, said amount. of 45533.36, expended by hire according to his contract for improving the said part of Henderson Avenue from the pavement at the in- tersection of Broadway and Henderson to the pavement at the intersection of Harmony and Henderson, and which sura is within the estimated cost for said im- provement made by the City Engineer and on file in the office of the City Clerk, the said sum of 45533.36 is hereby levied, apportioned, assessed and taxed against the lots, tracts, parts of lots and parcels of real property fronting or abutting on that _dart of Henderson Avenue from the intersection of Broadway and Henderson to the paveriient at the intersection of Harmony and Hen- derson, said lots, tracts, parts of lots and parcels lying, being and situate in the City of Cape Girardeau, County of Cape Girardeau and State of Missouri, said work of improvement on that part of said street having been previously found by said Council to have been done according to the plans and specifi- cations therefor and according to said Comr.lission Form Ordinances numbered 50 and 289, and according to the provisions of the contract for the doing of said improvement, and this method of assessment is hereby made by virtue of author- ity therefor, as provided in said Commission Form Ordinances numbered 50 and 289, and said lots, tracts, parts of lots and parcels, the names of the owners of each, so far as is 'known, the description thereof, the size, the front feet of same abutting on that part of said street improved and the amount of the cost against each parcel being as follows, to-ti,iit:- NAD,M OF OVITER . The City Clerk is hereby ordered to issue special tax bills in favor of F. W. Keller, contractor, for constructing and improving that part of Henderson Avenue hereinbefore described, against all the lots, tracts, parts of lots and parcels of ground fronting or abutting on said part of Henderson Ave- nue improved as hereinbefore set out and assessed and taxed as required by law and asprovided by the ordinances of said city, all of said special tax bills to be issued herein being a lien on said lots, tracts, parts of lots and parcels of ground described herein and said special tax bills to bear interest at the rate of 8�o per annum after 30 days from the date of their issuance until paid. It is further ordered that said special tax bills shall so state such fact of drawing interest and shall further state that they are a lien on the proper- ty described therein and that they shall further state the length of time dur- ing which said lien continues. It is further ordered that when said special tax bills are issued by the City Clerk as aforesaid, they shall be delivered to the said F. W. The City Clerk is hereby ordered to issue special tax bills in favor of F. W. Keller, contractor, for constructing and improving that part of Henderson Avenue hereinbefore described, against all the lots, tracts, parts of lots and parcels of ground fronting or abutting on said part of Henderson Ave- nue improved as hereinbefore set out and assessed and taxed as required by law and asprovided by the ordinances of said city, all of said special tax bills to be issued herein being a lien on said lots, tracts, parts of lots and parcels of ground described herein and said special tax bills to bear interest at the rate of 8�o per annum after 30 days from the date of their issuance until paid. It is further ordered that said special tax bills shall so state such fact of drawing interest and shall further state that they are a lien on the proper- ty described therein and that they shall further state the length of time dur- ing which said lien continues. It is further ordered that when said special tax bills are issued by the City Clerk as aforesaid, they shall be delivered to the said F. W.
